Legislator summary

AI generated

The Constitutional Court altered the appeal's effect from suspensive to merely devolutive. The appellant argued the suspension was erroneous, while the opposing party maintained the initial suspension. The court ruled that since the prior appeal was devolutive, the current appeal must follow the same effect under the relevant law.

ACÓRDÃO Nº 142/86

ACÓRDÃO N.º 142/86

Processo n.º 92/86

1.ª Secção

Relator: Conselheiro Vital Moreira

Vital Moreira

Antero Alves Monteiro Diniz

Raul Mateus

Armando Manuel Marques Guedes

Proc. Civil.

Lisboa, 18 de Abril de 1986

Vital Moreira
