Legislator summary

AI generated

The Constitutional Court altered the suspensive effect of a pending appeal to a merely devolutive effect. The Ministry of Public Prosecution argued that Article 78(3) of the Constitutional Court Law required this change because the underlying decision was already subject to a prior appeal. The Court agreed, ruling that the specific procedural stage necessitated the modification of the appeal's effect.

ACÓRDÃO Nº 13/86

ACÓRDÃO N.º 13/86

Processo n.º 140/85

1ª Secção

Relator: Conselheiro Vital Moreira
