Legislator summary

AI generated

The Constitutional Court dismissed the executive action initiated by A., Lda. against B., Lda., after noting the exequente had already received part of the claimed sum. Although the initial petition was partially rejected and the exequente declared lack of interest, the court ruled this did not constitute a formal withdrawal of the claim. Consequently, the process was ordered to continue to its natural conclusion rather than being terminated.

ACÓRDÃO N.º 89/85

Processo n.º 5/85

1.ª Secção

Relator: Conselheiro Martins da Fonseca

Acordam no Tribunal Constitucional

Adjuntos.
