Legislator summary

The Constitutional Court declined to examine the appeal regarding the application of Article 4 of the Decree-Law no. 262/83. Although the Court of Appeal had previously declared the article unconstitutional, the lower court's final judgment on interest rates was not appealed by the plaintiff, and the defendants had already paid higher amounts. Consequently, the Court ruled that its decision could not alter the final judgment since the constitutional question had already been resolved without affecting the outcome.

Acórdão 88/85

ACÓRDÃO Nº 88/85

Processo nº 193/84.

1.ª Secção.

Relator: Conselheiro Vital Moreira.

Acordam no Tribunal Constitucional, através da sua 1ª Secção:

Considerando que o Tribunal da Relação de Coimbra decidiu não aplicar o artigo 4ºdo Decreto-Lei nº 262/83, por o ter julgado inconstitucional;

Considerando que, apesar disso, esse juízo de inconstitucionalidade não teve qualquer efeito sobre a decisão da questão, pois que a decisão da 1ª instância, que havia condenado os réus ao pagamento de juros de 15 %, não foi objecto de recurso pela A., tendo os réus, por sua vez, aceitado pagar juros superiores a partir de 23 de Maio de 1983;

Considerando, por isso, que qualquer que fosse a decisão do Tribunal Constitucional sobre o presente recurso, também ela não poderia conduzir à modificação da decisão recorrida, quanto aos juros da obrigação cambiária;
