Portuguese Constitutional Court dismisses appeal as moot due to new lawsuit filed after initial rejection.
Legislator summary
AI generatedThe Constitutional Court declared the appeal extinct due to supervening inutilidade (uselessness). The plaintiff initially sued for damages, which was rejected, prompting the Ministry of Public Prosecution to appeal; however, the plaintiff subsequently filed a new lawsuit for interest under Article 476 of the Civil Procedure Code. The court ruled the original appeal moot because the new action rendered the previous proceedings unnecessary.
