Legislator summary

AI generated

The Tribunal Constitucional altered the procedural effect of a civil appeal from suspensive to merely devolutive. The applicant argued for immediate suspension based on the judge's initial ruling, while the relator noted the partial nature of the interim denial. The court decided to remove the suspensive effect because the partial denial did not terminate the proceedings, thereby allowing the case to continue while the appeal is reviewed.

2.ª Secção

Relator: Conselheiro Mário Afonso

Acordam no Tribunal Constitucional:

Lisboa, 10-12-84
