The Tribunal da Relação do Porto partially revoked a lower court decision regarding a dispute over a neighboring terrace construction and an alleged servitude path. The appellant argued that the new terrace with low parapets violated Article 1360 of the Civil Code, while the respondent claimed the servitude path was being misused for access to a house rather than the original agricultural purpose. The court held that the specific construction of low parapets within the required distance constitutes a violation, and the unauthorized use of the servitude for residential access justified awarding non-pecuniary damages to the affected property owner.
