Legislator summary

AI generated

The Tribunal da Relação de Lisboa revoked a previous decision regarding a lease dispute involving a tenant and landlord. The court found that while the new law could theoretically apply retroactively, it must respect the effects of prior judgments and that the tenant's use of the property was authorized by the previous owner. Consequently, the court ruled that this authorized use constituted a tacit alteration of the lease's purpose rather than a valid ground for termination.

SUMÁRIO

I - A resolução do contrato de arrendamento é susceptível de caducidade e não de prescrição;

II - A Lei nova, ainda que pretenda ter efeitos retroactivos tem de ressalvar os efeitos produzidos no domínio da Lei anterior, mormente quando haja sentença transitada em julgado;
