The Supreme Administrative Court dismissed the Ministry of Public Prosecution's appeal against a tax fine, ruling that the administrative decision failed to meet statutory requirements. The court held that the summary of facts in the fine must strictly describe the specific negligent act typified in Article 114 of the General Tax Offenses Regime, which presupposes the prior deduction of tax not paid. Consequently, the court found that merely stating the failure to deliver VAT did not satisfy the legal definition of the offense because VAT liability depends on the positive difference between input and output tax, not just the deduction itself.
