Kysymys urakkahinnoittelua koskevassa sopimuskohdassa tarkoitetun T-kappaleen teossa tarvittavan reiän korvaamisesta.

Sopimuskohtaa oli teollisuuseristystyötä tekevissä työnantajaliiton jäsenyrityksissä muutamaa poikkeusta lukuunottamatta sovellettu vakiintuneesti siten, että muotokappaleiden teossa, näihin luettuna riidanalainen T-kappale, oli maksettu yksikköhinta, johon olivat sisältyneet kappaleen teossa tarvittavat työvaiheet, reiän teko näihin luettuna. Se seikka yksinään, että samassa sopimuskohdassa oli sovittu yksikköhinta myös reiän teolle, joka saattoi tulla kysymykseen erillisenä työvaiheena ja erillisesti korvattavaksi, ei näissä oloissa riittänyt osoittamaan, että reiän teosta olisi työehtosopimuksen mukaan maksettava T-kappaleen teossa erikseen. Se seikka, että työntekijäliiton esitykset työehtosopimuksen sanamuodon muuttamiseksi kanteessa esitetyn kannan mukaiseksi eivät olleet johtaneet tulokseen työehtosopimusneuvotteluissa, ei sinänsä osoittanut, että työntekijäliitto olisi nimenomaisesti hyväksynyt työnantajaliiton tulkinnan.

Työnantaja ei ollut syyllistynyt työehtosopimuksen tietensä rikkomiseen eikä työnantajaliitto valvontavelvollisuutensa laiminlyömiseen.

Kanne oli perustettu uuteen työehtosopimukseen. Vaadittu kanteen jättämistä tutkimatta sillä perusteella, että se olisi pitänyt perustaa vanhaan työehtosopimukseen. Väite hylätty.
