Påstand om tilkendelse af sagsomkostninger i hævet småsag blev ikke imødekommet

Den 7. oktober 2011 kl. 10:00 blev retten sat på tingstedet af Dommer.

Der blev foretaget i ikke offentligt retsmøde sag nr. BS 20G-2308/2011:

Ingen indkaldt eller mødt.

Der blev fremlagt email af den 21. september 2011, den 26. september 2011 og den 30. september 2011 vedlagt omkostningsprocesskrift med bilag fra juridisk konsulent Person, processkrift og processkrift I fra advokat Jens Opstrup.

Sagsøgeren har meddelt, at sagen hæves, og har i øvrigt påstået sig tilkendt yderligere sagsomkostninger.

Bilka A/S har under sagen taget bekræftende til genmæle overfor den nedlagte påstand og har tillige betalt 500,00 kr. til Sagsøger til dækning af retsafgiften. Under hensyn hertil og idet sagen, der er behandlet efter reglerne om småsager, hæves under forberedelsen, bestemte retten, at Bilka A/S ikke skal betale yderligere sagsomkostninger til Sagsøger.
