The following are automatically entered on the margin of the birth register: a. any acknowledgment and its annulment; b. any adoption and its annulment; in the case of an adoption, the initial entry is replaced by a supplementary sheet, which must be removed in the event of annulment of the adoption; c. any determination of paternity; d. any subsequent marriage of the parents; e. any severance of the parental link with the mother's husband; f. any change of family name; fbis. any request for adaptation of the name's spelling pursuant to Art. 99 f; g. any change of first name; h. any change of sex.

The following are entered upon request on the margin of the birth register: a. any change of family name occurring between January 1, 1978, and the entry into force of paragraph 1, letter f; b. any change of first name occurring between January 1, 1978, and June 30, 1994; c. any change of sex occurring before January 1, 2002.

The following are entered on the margin of the death register simultaneously with the deletion of the entry: a. any annulment of the declaration of absence; b. any revocation of the determination of death.

When registering the corresponding civil status events in the civil status register, the following entries are simultaneously deleted from the family register: a. that of the child on the legal father's sheet if the parental link is severed; b. that of the child on the mother's and biological father's sheets if the parental link is severed due to adoption; c. that of the naturalization of a foreign person if the naturalization has been annulled.

The deletions mentioned in paragraph 4 must be justified; the sheets thus invalidated are removed.

The civil status office responsible for registering civil status data communicates to the civil status office in charge of updating the records kept on paper the events mentioned in paragraphs 1 to 4.

No updates are made in the civil status registers considered archival (Art. 6 a, paragraph 3).

Im Geburtsregister sind von Amtes wegen als Randanmerkung einzutragen: a. Kindesanerkennungen sowie deren Aufhebung; b. Adoptionen sowie deren Aufhebung; ausserdem ist bei einer Adoption die ursprüngliche Eintragung durch ein Deckblatt zu ersetzen; letzteres ist bei der Aufhebung zu entfernen; c. Feststellungen der Vaterschaft; d. nachträgliche Eheschliessungen der Eltern; e. Aufhebungen des Kindesverhältnisses zum Ehemann der Mutter; f. Familiennamensänderungen; fbis. {note: Eingefügt durch Ziff. I der V vom 26. Juni 2024, in Kraft seit 11. Nov. 2024 ( AS 2024 335).} Anpassungen der Namensschreibweise aufgrund von Anträgen nach Artikel 99 f; g. Vornamensänderungen; h. Geschlechtsänderungen.

Im Geburtsregister sind auf Antrag als Randanmerkung einzutragen: a. Familiennamensänderungen vom 1. Januar 1978 bis zum Inkrafttreten von Absatz 1 Buchstabe f; b. Vornamensänderungen vom 1. Januar 1978 bis zum 30. Juni 1994; c. Geschlechtsänderungen vor dem 1. Januar 2002.

Im Todesregister sind unter gleichzeitiger Löschung der Eintragung als Randanmerkung einzutragen: a. Aufhebungen der Verschollenerklärung; b. Widerrufe von Todesfeststellungen.

Anlässlich der Beurkundung der folgenden Zivilstandsereignisse im Personenstandsregister sind im Familienregister zu löschen die Eintragung betreffend: a. das Kind im Blatt des rechtlichen Vaters, wenn das Kindesverhältnis zu ihm aufgehoben worden ist; b. das Kind im Blatt der leiblichen Mutter und des leiblichen Vaters, wenn das Kindesverhältnis durch Adoption erloschen ist; c. die Einbürgerung einer Ausländerin oder eines Ausländers, wenn sie nichtig erklärt worden ist.

Die Löschungen nach Absatz 4 werden begründet; dadurch ungültig gewordene Blätter werden gelöscht.

Das für die Beurkundung zuständige Zivilstandsamt meldet die Zivilstandsereignisse und Zivilstandstatsachen nach den Absätzen 1–4 dem für die Nachführung der in Papierform geführten Zivilstandsregister zuständigen Zivilstandsamt.

Die Zivilstandsregister, die als Archivgut gelten (Art. 6 a Abs. 3), werden nicht nachgeführt. {note: Eingefügt durch Ziff. I der V vom 26. Okt. 2016, in Kraft seit 1. Juli 2017 ( AS 2016 3925).}

Sont inscrits d’office en marge du registre des naissances: {note: Nouvelle teneur selon le ch. I de l’O du 26 juin 2024, en vigueur depuis le 11 nov. 2024 ( RO 2024 335).} a. toute reconnaissance et son annulation; b. toute adoption et son annulation; lors d’une adoption, l’inscription initiale est remplacée par une feuille complémentaire; cette dernière doit être retirée en cas d’annulation de l’adoption; c. toute constatation de la paternité; d. tout mariage ultérieur des parents; e. toute rupture du lien de filiation avec le mari de la mère; f. tout changement de nom de famille; fbis. {note: Introduite par le ch. I de l’O du 26 juin 2024, en vigueur depuis le 11 nov. 2024 ( RO 2024 335).} toute demande d’adaptation de la graphie du nom en vertu de l’art. 99 f; g. tout changement de prénom; h. tout changement de sexe.

Sont inscrits sur demande en marge du registre des naissances: a. tout changement de nom de famille intervenu entre le 1 er janvier 1978 et l’entrée en vigueur de l’al. 1, let. f; b. tout changement de prénom intervenu entre le 1 er janvier 1978 et le 30 juin 1994; c. tout changement de sexe intervenu avant le 1 er janvier 2002.

Sont inscrits en marge du registre des décès en même temps que la radiation de l’inscription: a. toute annulation de la déclaration d’absence; b. toute révocation de la constatation de décès.

Lors de l’enregistrement des faits d’état civil correspondants dans le registre de l’état civil, les inscriptions suivantes sont radiées simultanément au registre des familles: a. celle de l’enfant sur le feuillet du père juridique si le lien de filiation est rompu; b. celle de l’enfant sur le feuillet de la mère et du père biologiques si le lien de filiation est rompu en raison de l’adoption; c. celle de la naturalisation d’une personne étrangère si la naturalisation a été annulée.

Les radiations mentionnées à l’al. 4 doivent être justifiées; les feuillets ainsi invalidés sont supprimés.

L’office de l’état civil compétent pour enregistrer les données de l’état civil communique à l’office de l’état civil en charge de la mise à jour des registres tenus sur papier les faits mentionnés aux al. 1 à 4.

Aucune mise à jour n’est effectuée dans les registres de l’état civil considérés comme des archives (art. 6 a, al. 3). {note: Introduit par le ch. I de l’O du 26 oct. 2016, en vigueur depuis le 1 er juil. 2017 ( RO 2016 3925 5111).}

Nel registro delle nascite vanno iscritte d’ufficio le seguenti annotazioni a margine: a. il riconoscimento nonché l’annullamento del riconoscimento; b. l’adozione nonché l’annullamento dell’adozione; inoltre, in caso di adozione, l’iscrizione originaria va sostituita con un frontespizio che va eliminato se l’adozione è annullata; c. l’accertamento della paternità; d. il matrimonio successivo dei genitori; e. l’annullamento del rapporto di filiazione con il marito della madre; f. il cambiamento del cognome; fbis. {note: Introdotta dalla cifra I dell’O del 26 giu. 2024, in vigore dall’11 nov. 2024 ( RU 2024 335).} adeguamenti della grafia dei nomi in seguito alle richieste secondo l’articolo 99 f; g. il cambiamento del nome; h. il cambiamento di sesso.

Nel registro delle nascite vanno iscritte su richiesta le seguenti annotazioni a margine: a. il cambiamento del cognome tra il 1° gennaio 1978 e l’entrata in vigore del capoverso 1 lettera f del presente articolo; b. il cambiamento del nome tra il 1° gennaio 1978 e il 30 giugno 1994; c. il cambiamento di sesso avvenuto prima del 1° gennaio 2002.

Nel momento in cui si radia un’iscrizione nel registro delle morti, va annotato a margine: a. l’annullamento della dichiarazione di scomparsa; b. la revoca dell’accertamento della morte.

Vanno radiate dal registro delle famiglie le iscrizioni concernenti: a. il figlio nel foglio del padre giuridico, nel momento in cui si documenta nel registro dello stato civile lo scioglimento del rapporto di filiazione; b. il figlio nel foglio della madre biologica e del padre biologico, nel momento in cui si documenta nel registro dello stato civile lo scioglimento del rapporto di filiazione in seguito all’adozione; c. la naturalizzazione di uno straniero, nel momento in cui se ne documenta l’annullamento nel registro dello stato civile.

Le radiazioni effettuate in conformità del capoverso 4 devono essere motivate; i fogli così invalidati sono radiati.

L’ufficio dello stato civile competente per la documentazione comunica i fatti di stato civile menzionati nei capoversi 1–4 all’ufficio dello stato civile competente per aggiornare i registri dello stato civile cartacei.
