The application must be submitted to the cantonal authority within the first 35 weeks of monitored unemployment. It must include a developed plan and detailed documents related to the capital requirements and financing for the first year of operation.

The cantonal authority examines whether the conditions referred to in Art. 71b, para. 1, let. a to c, LACI, and Art. 95b, para. 1, let. a and b, are met and submits the received documents for a formal review. The review must be conducted within four weeks following the dispatch of the application. If the conditions are met, the cantonal authority forwards the application along with a copy of the corresponding decision to the competent guarantee organization for substantive examination.

The competent guarantee organization makes a decision within four weeks following the dispatch of the application and sends a copy of its decision to the cantonal authority.

If a guarantee is granted under the law of October 6, 2006, on financial assistance to guarantee organizations in favor of small and medium-sized enterprises, the compensation fund covers an additional 20% of the loss risk for the benefit of the guarantee organization. The cantonal authority issues a decision on the amount guaranteed by the compensation fund.

Das Gesuch ist innert der ersten 35 Wochen kontrollierter Arbeitslosigkeit bei der kantonalen Amtsstelle einzureichen. Es muss ein ausgearbeitetes Projekt mit detaillierten Unterlagen über den Kapitalbedarf sowie über die Finanzierung während des ersten Geschäftsjahres enthalten.

Die kantonale Amtsstelle prüft die Anspruchsvoraussetzungen nach Artikel 71 b Absatz 1 Buchstaben a–c AVIG sowie die Bedingungen nach Artikel 95 b Absatz 1 Buchstaben a und b und unterzieht die eingereichten Unterlagen einer formellen Prüfung. Die Prüfung muss innert vier Wochen nach Zustellung des Gesuchs erfolgen. Sind die Erfordernisse erfüllt, so leitet die kantonale Amtsstelle das Gesuch der zuständigen Bürgschaftsorganisation mit einer Kopie der entsprechenden Verfügung zur materiellen Prüfung weiter.

Die zuständige Bürgschaftsorganisation entscheidet innert vier Wochen nach Zustellung des Gesuches und stellt eine Kopie ihres Entscheides der kantonalen Amtsstelle zu.

Wird eine Bürgschaft nach dem Bundesgesetz vom 6. Oktober 2006 {note: SR 951.25} über die Finanzhilfen an gewerbeorientierte Bürgschaftsorganisationen gewährt, so übernimmt der Ausgleichsfonds zugunsten der Bürgschaftsorganisation zusätzlich 20 Prozent des Verlustrisikos. Die kantonale Amtsstelle erlässt eine Verfügung über den vom Ausgleichsfonds garantierten Betrag.

La demande doit être présentée à l’autorité cantonale dans les 35 premières semaines de chômage contrôlé. Elle doit contenir un projet mis au point et des documents détaillés relatifs au besoin en capital ainsi qu’au financement pendant la première année d’activité.

L’autorité cantonale examine si les conditions visées à l’art. 71 b, al. 1, let. a à c, LACI et à l’art. 95 b, al. 1, let. a et b, sont remplies et soumet les documents reçus à un examen formel. L’examen doit être effectué dans les quatre semaines qui suivent l’expédition de la demande. Si les conditions sont remplies, l’autorité cantonale transmet la demande accompagnée d’une copie de la décision correspondante à l’organisation de cautionnement compétente pour examen matériel.

Si un cautionnement est accordé en vertu de la loi du 6 octobre 2006 sur les aides financières aux organisations de cautionnement en faveur des petites et moyennes entreprises {note: RS 951.25} , le fonds de compensation prend à sa charge la couverture de 20 % supplémentaires des risques de perte au profit de l’organisation de cautionnement. L’autorité cantonale rend une décision sur le montant garanti par le fonds de compensation.

La domanda deve essere presentata al servizio cantonale entro le prime 35 settimane di disoccupazione controllata. Essa deve contenere un progetto elaborato con documenti dettagliati concernenti il fabbisogno in capitale nonché il finanziamento durante il primo anno d’esercizio.

Il servizio cantonale esamina se sono adempiute le condizioni che danno diritto alle prestazioni conformemente all’articolo 71 b capoverso 1 lettere a–c LADI e le condizioni di cui all’articolo 95 b capoverso 1 lettere a e b e sottopone i documenti presentati a un esame formale. L’esame deve essere effettuato entro quattro settimane dalla consegna della domanda. Se i requisiti sono adempiuti, il servizio cantonale inoltra la domanda con una copia della corrispondente decisione all’organizzazione di fideiussione competente, per esame materiale.

L’organizzazione di fideiussione competente decide entro quattro settimane dalla consegna della domanda e invia una copia della sua decisione al servizio cantonale.

Se è concessa una fideiussione in virtù della legge federale del 6 ottobre 2006 {note: RS 951.25} sugli aiuti finanziari alle organizzazioni che concedono fideiussioni alle piccole e medie imprese, il fondo di compensazione prende ulteriormente a carico il 20 per cento dei rischi di perdita a beneficio dell’organizzazione di fideiussione. Il servizio cantonale emana una decisione concernente l’importo garantito dal fondo di compensazione.
