The competent federal or cantonal authority shall dissolve the foundation on application or of its own accord if: 1. its objects have become unattainable and the foundation cannot be maintained by modifying its charter; or 2. its objects have become unlawful or immoral.

Family and ecclesiastical foundations shall be dissolved by court order.

Die zuständige Bundes- oder Kantonsbehörde hebt die Stiftung auf Antrag oder von Amtes wegen auf, wenn: 1. deren Zweck unerreichbar geworden ist und die Stiftung durch eine Änderung der Stiftungsurkunde nicht aufrechterhalten werden kann; oder 2. deren Zweck widerrechtlich oder unsittlich geworden ist.

Familienstiftungen und kirchliche Stiftungen werden durch das Gericht aufgehoben.

L’autorité fédérale ou cantonale compétente prononce la dissolution de la fondation, sur requête ou d’office lorsque: 1. le but de la fondation ne peut plus être atteint et que la fondation ne peut être maintenue par une modification de l’acte de fondation ou 2. le but de la fondation est devenu illicite ou contraire aux mœurs.

La dissolution de fondations de famille et de fondations ecclésiastiques est prononcée par le tribunal.

L’autorità federale o cantonale competente pronuncia la soppressione della fondazione, su richiesta o d’ufficio, se: 1. il fine non può più essere conseguito e la fondazione non può essere mantenuta mediante una modifica dell’atto di fondazione; o 2. il fine è diventato illecito o immorale.

La soppressione delle fondazioni di famiglia e delle fondazioni ecclesiastiche è pronunciata dal giudice.
