Art. 8 Ordinance of DETEC of 3 December 2008 on Exemptions Concerning Network Access and Attributable Network Costs at the Level of Cross-Border Transmission Network (Odac) - Allocation within the Framework of Cross-Border Network Use - English

For the capacity benefiting from the exemption, the operator shall have no right to the revenue from the cross-border use of the transmission network referred to in Art. 14, para. 2, OApEl.

If the condition set forth in Art. 2, para. 1, let. e, is no longer fulfilled, ElCom may charge the operator the difference between the shortfall and the increase in revenue. This amount is allocated to covering the attributable costs of the transmission network (Art. 14, para. 2, OApEl).

Der Betreiber hat für die vom Netzzugang ausgenommene Kapazität keinen Anspruch auf Einnahmen aus der grenzüberschreitenden Nutzung des Übertragungsnetzes nach Artikel 14 Absatz 2 StromVV.

Ist die Voraussetzung nach Artikel 2 Absatz 1 Buchstabe e nicht mehr erfüllt, so kann die ElCom dem Betreiber die Differenz zwischen den Mindererlösen und dem Mehrerlös in Rechnung stellen. Dieser Betrag wird für die Deckung der anrechenbaren Kosten des Übertragungsnetzes verwendet (Art. 14 Abs. 2 StromVV).

Pour la capacité bénéficiant de la dérogation, l’exploitant n’a nul droit aux recettes provenant de l’utilisation transfrontalière du réseau de transport visées à l’art. 14, al. 2, OApEl.

Si la condition fixée à l’art. 2, al. 1, let. e, n’est plus remplie, l’ElCom peut facturer à l’exploitant la différence entre le manque à gagner et l’accroissement de recettes. Ce montant est affecté à la couverture des coûts imputables du réseau de transport (art. 14, al. 2, OApEl).

Per la capacità oggetto di eccezione all’accesso alla rete, il gestore non ha diritto alle entrate risultanti dall’utilizzazione transfrontaliera della rete di trasporto secondo l’articolo 14 capoverso 2 OAEl. [tab] 2 Se la condizione di cui all’articolo 2 capoverso 1 lettera e non è più soddisfatta, la ElCom può fatturare al gestore la differenza fra le perdite di guadagno e i maggiori guadagni. Tale importo è impiegato per la copertura dei costi computabili della rete di trasporto (art. 14 cpv. 2 OAEl).
