In special cases, the Federal Council or its designated authority may prohibit the import, export, transit and brokerage of nuclear materials, or attach certain conditions thereto, regardless of whether a licensing obligation may exist, if such measures are required in the interests of the non-proliferation of nuclear arms.
For the purpose of implementing international treaties, the Federal Council may rule that no licences are to be issued for certain countries or for a specified group of countries.
The Federal Council may grant exemption from, or the easing of, licensing obligations, especially for deliveries to countries that are contractual parties to international treaties on the non-proliferation of nuclear arms or which participate in control measures supported by Switzerland.
Unabhängig davon, ob eine Bewilligungspflicht besteht, kann der Bundesrat oder die vom ihm bezeichnete Behörde die Einfuhr, Ausfuhr, Durchfuhr und Vermittlung von nuklearen Gütern im Einzelfall verbieten oder mit Bedingungen oder Auflagen versehen, wenn dies im Interesse der Nichtverbreitung von Kernwaffen geboten ist.
Zur Durchführung von internationalen Abkommen kann der Bundesrat vorsehen, dass für einzelne Bestimmungsländer oder eine Gruppe von Ländern keine Bewilligungen erteilt werden.
Der Bundesrat kann Erleichterungen und Ausnahmen von der Bewilligungspflicht vorsehen, insbesondere für Lieferungen in Länder, die Vertragsparteien von internationalen Abkommen über die Nichtverbreitung von Kernwaffen sind oder die sich an von der Schweiz unterstützten Kontrollmassnahmen beteiligen.
Indépendamment du régime de l’autorisation, le Conseil fédéral ou l’autorité désignée par lui peut, dans des cas d’espèce et lorsqu’il s’agit d’assurer la non-prolifération des armes nucléaires, interdire ou assortir de conditions et de charges l’importation, l’exportation, le transit ou le courtage d’articles nucléaires.
Le Conseil fédéral peut, pour se conformer aux accords internationaux, prévoir de n’accorder aucune autorisation pour certains États ou groupes d’États.
Le Conseil fédéral peut prévoir d’alléger le régime de l’autorisation ou d’y déroger, notamment en cas de fourniture à des États qui sont parties aux accords internationaux sur la non-prolifération des armes nucléaires ou qui participent à des mesures de contrôle soutenues par la Suisse.
Indipendentemente dall’obbligo di licenza, il Consiglio federale o l’autorità da esso designata può vietare l’importazione, l’esportazione, il transito e l’intermediazione di beni nucleari nel singolo caso o vincolarli a condizioni o oneri se necessario nell’interesse della non proliferazione delle armi nucleari.
Per eseguire accordi internazionali, il Consiglio federale può prevedere che per determinati Paesi di destinazione o per un gruppo di Paesi non sia rilasciata alcuna licenza.
Il Consiglio federale può prevedere agevolazioni ed eccezioni all’obbligo di licenza, segnatamente per forniture a Paesi che sono Parti ad accordi internazionali sulla non proliferazione delle armi nucleari o che partecipano a provvedimenti di controllo sostenuti dalla Svizzera.
