When the defendant is ordered to make a declaration of intent, the judgment serves as the declaration. If this is conditional upon a circumstance or a counter-performance, the judgment takes effect as soon as the court has made the determination provided for in Art. 74, para. 2.

When the declaration of intent concerns a right that must be registered in the land register, the judge issues, within the judgment, the authorization to proceed with the registration, in accordance with Arts. 18 and 19 of the Ordinance of February 22, 1910 on the Land Register.

Ist der Beklagte zur Abgabe einer Willenserklärung verurteilt, so wird die Erklärung durch das Urteil ersetzt. Ist sie von einer Bedingung oder Gegenleistung abhängig, so tritt diese Wirkung mit der Feststellung gemäss Artikel 74 Absatz 2 ein.

Betrifft die Willenserklärung ein im Grundbuch einzutragendes Recht, so erteilt der Richter im Urteil die Ermächtigung zur Eintragung im Sinne der Artikel 18 und 19 der Verordnung vom 22. Februar 1910 {note: SR 211.432.1} betreffend das Grundbuch.

Lorsque le défendeur est condamné à faire une déclaration de volonté, le jugement tient lieu de la déclaration. Si celle-ci dépend d’une condition ou d’une contre-prestation, le jugement produit effet dès que le tribunal a fait la constatation prévue par l’art. 74, al. 2.

Lorsque la déclaration de volonté concerne un droit qui doit être inscrit au registre foncier, le juge délivre dans le jugement l’autorisation d’opérer l’inscription, conformément aux art. 18 et 19 de l’ordonnance du 22 février 1910 sur le registre foncier {note: RS 211.432.1} .

Quando il convenuto è condannato a fare una dichiarazione di volontà, la sentenza sostituisce la dichiarazione. Se questa dipende da una condizione o da una controprestazione, la sentenza produce effetto quando è intervenuto l’accertamento previsto dall’articolo 74 capoverso 2.

Quando la dichiarazione di volontà concerne un diritto che dev’essere iscritto nel registro fondiario, il giudice conferisce nella sentenza l’autorizzazione di eseguire l’iscrizione, conformemente agli articoli 18 e 19 del regolamento del 22 febbraio 1910 {note: RS 211.432.1} per il registro fondiario.
