The FOPH grants federal contributions based on a public law contract within the meaning of Art. 16, para. 2, of the Federal Act of October 5, 1990, on Subsidies (SubA).
The contract shall regulate, in particular: a. the cantonal services to be provided; b. the amount of the Confederation's financial participation; c. the payment modalities; d. the consequences of non-performance or imperfect performance of services by the canton; e. the modalities of the annual report that the cantons must submit to the FOPH.
The procedure for granting federal contributions is governed by the provisions of the SubA.
Art. 28 SubA shall apply mutatis mutandis to the procedure in the event of non-performance or imperfect performance of services by the canton.
Das BAG gewährt die Bundesbeiträge auf der Grundlage eines öffentlich-rechtlichen Vertrags nach Artikel 16 Absatz 2 des Subventionsgesetzes vom 5. Oktober 1990 {note: SR 616.1} (SuG).
Der Vertrag regelt insbesondere: a. die zu erfüllenden Leistungen des Kantons; b. die Höhe der finanziellen Beteiligung des Bundes; c. die Zahlungsmodalitäten; d. die Folgen einer Nichterfüllung oder einer mangelhaften Erfüllung der Leistungen durch den Kanton; und e. die jährliche Berichterstattung des Kantons zuhanden des BAG.
Das Verfahren für die Gewährung von Bundesbeiträgen richtet sich nach den Bestimmungen des SuG.
Das Vorgehen bei einer Nichterfüllung oder mangelhaften Erfüllung der Leistungen durch den Kanton richtet sich sinngemäss nach Artikel 28 SuG.
L’OFSP octroie les contributions fédérales sur la base d’un contrat de droit public au sens de l’art. 16, al. 2, de la loi du 5 octobre 1990 sur les subventions (LSu) {note: RS 616.1} .
Le contrat règle notamment: a. les prestations cantonales à fournir; b. le montant de la participation financière de la Confédération; c. les modalités de paiement; d. les conséquences de la non-exécution ou de l’exécution imparfaite des prestations par le canton; e. les modalités du rapport annuel que les cantons doivent adresser à l’OFSP.
La procédure d’octroi des contributions fédérales est régie par les dispositions de la LSu.
L’art. 28 LSu s’applique par analogie à la procédure en cas de non-exécution ou d’exécution imparfaite des prestations par le canton.
L’UFSP accorda i contributi federali sulla base di un contratto di diritto pubblico secondo l’articolo 16 capoverso 2 della legge del 5 ottobre 1990 {note: RS 616.1} sui sussidi (LSu).
Il contratto disciplina in particolare: a. le prestazioni cantonali da adempiere; b. l’ammontare della partecipazione finanziaria della Confederazione; c. le modalità di pagamento; d. le conseguenze dell’inadempienza totale o parziale delle prestazioni da parte del Cantone; e e. la presentazione di rendiconti annuali all’UFSP da parte dei Cantoni.
La procedura per la concessione di contributi federali è retta dalle disposizioni della LSu.
La procedura in caso di inadempienza totale o parziale delle prestazioni cantonali è retta per analogia dall’articolo 28 LSu.
