Swissmedic may assign the competent cantonal authorities to perform specific checks if there is suspicion of irregularities, or it may itself inspect the license holder in place of the cantonal authorities if they are unable to conduct the checks.

It ensures compliance, in collaboration with the Federal Office for Customs and Border Security (FOCBS), with the provisions relating to the import, export, and transit of substances subject to control.

It may collect samples of substances potentially subject to control for analysis at no charge. A receipt will be issued to the owner.

It is authorized to inspect substances subject to control that are stored under customs supervision at any time, particularly those placed in open customs warehouses, in warehouses for mass consumer goods, or in bonded warehouses, and to take measures in the event of inaccuracies. It may delegate this task to the competent cantonal authorities.

Die Swissmedic kann bei Verdacht auf Unregelmässigkeiten die zuständigen kantonalen Behörden beauftragen, besondere Kontrollen durchzuführen, oder anstelle der zuständigen kantonalen Behörden die Kontrolle der Bewilligungsinhaberin oder Bewilligungsinhaber selber vornehmen, wenn diese sie nicht wahrnehmen können.

Sie kontrolliert in Zusammenarbeit mit dem BAZG die Einhaltung der Bestimmungen über die Ein-, Aus- und Durchfuhr von kontrollierten Substanzen.

Zu Analysezwecken kann sie unentgeltlich Muster von Substanzen entnehmen, die der Kontrolle unterliegen könnten. Sie stellt der Eigentümerin oder dem Eigentümer eine Quittung aus.

Sie ist jederzeit befugt, die unter Zollüberwachung stehenden kontrollierten Substanzen, insbesondere solcher, die in offenen Zolllagern, Lagern für Massengüter oder Zollfreilagern aufbewahrt werden, zu kontrollieren und bei Unstimmigkeiten Massnahmen zu verfügen. Sie kann damit die zuständigen kantonalen Behörden beauftragen.

Swissmedic peut charger les autorités cantonales compétentes d’effectuer des contrôles particuliers s’il soupçonne des irrégularités ou contrôler le titulaire de l’autorisation en lieu et place des autorités cantonales si celles-ci ne sont pas en mesure d’effectuer les contrôles.

Il contrôle, en collaboration avec l’OFDF, le respect des dispositions relatives à l’importation, à l’exportation et au transit de substances soumises à contrôle.

Il peut prélever gratuitement pour analyse des échantillons de substances susceptibles d’être soumises à contrôle. Il délivre une quittance au propriétaire.

Il est habilité à contrôler à tout moment les substances soumises à contrôle stockées sous surveillance douanière, en particulier celles qui sont placées dans des entrepôts douaniers ouverts, dans des entrepôts de marchandises de grande consommation ou dans des dépôts francs sous douane, et à prendre des mesures en cas d’inexactitudes. Il peut mandater à cet effet les autorités cantonales compétentes.

Swissmedic può incaricare le autorità cantonali competenti di eseguire speciali controlli in caso di sospetto di irregolarità oppure può controllare direttamente il titolare dell’autorizzazione al posto delle competenti autorità cantonali, se queste ultime non possono farlo.
