If the recipient of a promised compensatory payment or financial assistance despite being warned fails to carry out a measure not or does so inadequately, the compensatory payment or financial assistance shall not be paid out or shall be reduced.

If compensatory payments or financial assistance have been paid out and the recipient despite being warned fails to carry out a measure not or does so inadequately, the payments may be reclaimed in accordance with Articles 28 and 29 of the Subsidies Act {note: SR 616.1} .

If installations or equipment for which compensatory payments or financial assistance have been paid out are used for a purpose other than that intended, the FOEN may require the canton to stop or remedy the misuse within a reasonable period.

If the misuse is not stopped or remedied, the payments may be reclaimed in accordance with Article 29 of the Subsidies Act.

Erfüllt der Empfänger einer zugesicherten Abgeltung oder Finanzhilfe die Massnahme trotz Mahnung nicht oder mangelhaft, so wird die Abgeltung oder Finanzhilfe nicht ausbezahlt oder gekürzt.

Sind Abgeltungen oder Finanzhilfen ausbezahlt worden und erfüllt der Empfänger trotz Mahnung die Massnahme nicht oder mangelhaft, so richtet sich die Rückforderung nach Artikel 28 SuG {note: SR 616.1} .

Werden Anlagen oder Einrichtungen, an die Abgeltungen oder Finanzhilfen geleistet wurden, ihrem Zweck entfremdet, so kann das BAFU vom Kanton verlangen, dass er innerhalb einer angemessenen Frist die Unterlassung oder Rückgängigmachung der Zweckentfremdung erwirkt.

Wird die Zweckentfremdung nicht unterlassen oder nicht rückgängig gemacht, so richtet sich die Rückforderung nach Artikel 29 SuG.

Se la sottrazione allo scopo non cessa o non è annullata, la restituzione è retta dall’articolo 29 LSu.
