Any person wishing to construct or modify water retaining facilities requires planning approval from the relevant licensing authority.
Where the construction or modification of an installation has to be approved on the basis of other legal provisions, at the same time as the decision on approval in accordance with those legal provisions a decision shall be made on whether to grant planning approval under this Act.
Planning approval must be granted if the technical safety requirements are complied with.
The application for planning approval must include all the information required to carry out the technical safety assessment.
The supervisory authority examines the application. If the supervisory authority is not the licensing authority, it shall inform the latter of the result of its technical safety assessment. If deemed necessary for ensuring the technical safety of the installation, the supervisory authority shall specify conditions concerning its construction.
When making its decision, the licensing authority considers the result of the technical safety assessment and the requested conditions for ensuring the technical safety of the installation.
The licensing authority shall order special structural measures if these are required to protect the installation against acts of sabotage.
During the construction phase, the supervisory authority shall verify whether the specified technical safety requirements are complied with.
Wer eine Stauanlage bauen oder ändern will, braucht eine Plangenehmigung der zuständigen Genehmigungsbehörde.
Soweit der Bau oder die Ă„nderung einer Anlage nach einem andern Gesetz genehmigt werden muss, wird mit dem Entscheid ĂĽber die Genehmigung nach jenem Gesetz auch ĂĽber die Erteilung der Plangenehmigung nach diesem Gesetz entschieden.
Die Plangenehmigung ist zu erteilen, wenn die Anforderungen an die technische Sicherheit erfĂĽllt werden.
Das Gesuch um eine Plangenehmigung muss alle Angaben enthalten, welche fĂĽr die sicherheitstechnische Beurteilung erforderlich sind.
Die Aufsichtsbehörde prüft das Gesuch. Ist sie nicht Genehmigungsbehörde, so teilt sie dieser das Ergebnis ihrer sicherheitstechnischen Prüfung mit. Soweit die technische Sicherheit der Anlage es erfordert, beantragt sie der Genehmigungsbehörde Auflagen für den Bau.
Die Genehmigungsbehörde nimmt das Ergebnis der sicherheitstechnischen Prüfung und die beantragten Auflagen betreffend die technische Sicherheit in ihren Entscheid auf.
Sie ordnet besondere bauliche Vorkehrungen an, wenn dies zum Schutz vor Sabotageakten erforderlich ist.
Die Aufsichtsbehörde kontrolliert während der Bauausführung, ob die Anforderungen an die technische Sicherheit eingehalten werden.
Quiconque souhaite construire ou modifier un ouvrage d’accumulation doit être titulaire d’une approbation des plans délivrée par l’autorité compétente.
Lorsque la construction ou la modification d’un ouvrage d’accumulation doivent être autorisées en vertu d’une autre loi, la décision d’autorisation prise en vertu de cette autre loi est également déterminante pour l’approbation des plans visée dans la présente loi.
La demande d’approbation des plans est approuvée si les exigences de sécurité technique sont remplies.
La demande doit comporter toutes les indications requises pour l’évaluation de la sécurité technique.
L’autorité de surveillance examine la demande. Si elle n’est pas l’autorité d’approbation, elle informe celle-ci du résultat de l’examen de la sécurité technique. Dans la mesure où la sécurité technique de l’installation l’exige, elle lui propose de fixer des conditions relatives à la construction.
L’autorité d’approbation inclut dans sa décision le résultat de l’examen de la sécurité technique et les conditions relatives à la sécurité technique.
L’autorité d’approbation ordonne des mesures techniques particulières lorsque la protection de l’ouvrage contre les actes de sabotage l’exige.
Pendant la réalisation des travaux de construction, l’autorité de surveillance contrôle si les exigences de sécurité technique sont remplies.
Chi intende costruire o modificare un impianto di accumulazione necessita di un’approvazione dei piani rilasciata dalla competente autorità .
Qualora la costruzione o la modifica di un impianto di accumulazione debba essere autorizzata in virtù di un’altra legge, la decisione di autorizzazione presa in virtù di tale legge è determinante anche per il rilascio dell’approvazione dei piani secondo la presente legge.
L’approvazione dei piani è rilasciata se i requisiti di sicurezza tecnica sono adempiuti.
La domanda di approvazione dei piani deve contenere tutte le indicazioni necessarie per la valutazione della sicurezza tecnica.
L’autorità di vigilanza esamina la domanda. Se non è l’autorità d’approvazione, comunica a quest’ultima il risultato del suo esame della sicurezza tecnica. Per quanto la sicurezza tecnica dell’impianto lo esiga, propone all’autorità d’approvazione dei piani oneri per la costruzione.
L’autorità di approvazione integra nella sua decisione il risultato dell’esame della sicurezza tecnica e gli oneri proposti in materia di sicurezza tecnica.
Se necessario per proteggere l’impianto da atti di sabotaggio, l’autorità di approvazione ordina provvedimenti edilizi particolari.
Durante i lavori di costruzione, l’autorità di vigilanza controlla se i requisiti di sicurezza tecnica sono rispettati.
