The limitation period for actions seeking compensation for damage is governed by Art. 60 of the Code of Obligations.

If the damage is caused by the use of pathogenic organisms, actions for compensation are limited to three years from the day the injured party became aware of the damage and the identity of the legally responsible person, but no more than 30 years from the day: a. the harmful event occurred or ceased to occur within the business or facility, or b. the pathogenic organisms were placed on the market.

Ist der Schaden wegen des Umgangs mit pathogenen Organismen entstanden, verjähren die Ersatzansprüche drei Jahre, nachdem die geschädigte Person Kenntnis vom Schaden und von der haftpflichtigen Person erlangt hat, spätestens aber 30 Jahre nachdem: a. das Ereignis, das den Schaden verursacht hat, im Betrieb oder in der Anlage eingetreten ist oder ein Ende gefunden hat; oder b. die pathogenen Organismen in Verkehr gebracht worden sind.

La prescription des actions en réparation du dommage est régie par l’art. 60 du code des obligations {note: RS 220} .

Si le dommage est dû à l’utilisation d’organismes pathogènes, les actions en réparation du dommage se prescrivent par trois ans à compter du jour où le lésé a eu connaissance du dommage et de l’identité de la personne légalement responsable, mais au plus par 30 ans à compter du jour où: a. l’événement dommageable s’est produit ou a cessé de se produire dans l’entreprise ou l’installation ou b. les organismes pathogènes ont été mis dans le commerce.

Se il danno è stato causato dall’utilizzazione di organismi patogeni, le pretese di risarcimento si prescrivono in tre anni dal giorno in cui il danneggiato ha avuto conoscenza del danno e del responsabile, ma al più tardi dopo trent’anni dal giorno in cui: a. l’evento che ha provocato il danno si è verificato o si è concluso nell’azienda o nell’impianto; o b. gli organismi patogeni sono stati messi in commercio.
