If the beneficiary or their representative, with the intent to deceive the insurance company, conceals or inaccurately reports facts that would have excluded or restricted the insurance company's obligation, or if, with the intent to deceive the insurance company, they fail to make or delay making the communications required by Art. 39 of this Act, the insurance company is not bound by the contract towards the beneficiary.

Hat der Anspruchsberechtigte oder sein Vertreter Tatsachen, welche die Leistungspflicht des Versicherungsunternehmens ausschliessen oder mindern würden, zum Zwecke der Täuschung unrichtig mitgeteilt oder verschwiegen oder hat er die ihm nach Massgabe des Artikels 39 dieses Gesetzes obliegenden Mitteilungen zum Zwecke der Täuschung zu spät oder gar nicht gemacht, so ist das Versicherungsunternehmen gegenüber dem Anspruchsberechtigten an den Vertrag nicht gebunden.

Si l’ayant droit ou son représentant, dans le but d’induire l’entreprise d’assurance en erreur, dissimule ou déclare inexactement des faits qui auraient exclu ou restreint l’obligation de l’entreprise d’assurance, ou si, dans le but d’induire l’entreprise d’assurance en erreur, il ne fait pas ou fait tardivement les communications que lui impose l’art. 39 de la présente loi, l’entreprise d’assurance n’est pas liée par le contrat envers l’ayant droit.

L’assicuratore non è vincolato al contratto di fronte all’avente diritto, se questi od il suo rappresentante, nell’intento d’indurlo in errore, ha dichiarato inesattamente o taciuto dei fatti che escluderebbero o limiterebbero l’obbligo dell’assicuratore, o se, nel medesimo intento, egli non ha fatto o ha fatto tardivamente le comunicazioni che per l’articolo 39 della presente legge gl’incombono.
