Effective technological measures for the protection of works and other protected subject-matter may not be circumvented.

Effective technological measures in accordance with paragraph 1 means technologies and devices such as access control, copy control, encryption, scrambling and other modification mechanisms that are intended and suitable for preventing or limiting the unauthorised use of works and other subject-matter.

It is unlawful to manufacture, import, offer, transfer or otherwise distribute, rent, give for use, and advertise or possess for commercial purposes devices, products or components, or provide services which: a. are the subject-matter of sales promotion, advertising or marketing with the goal of circumventing effective technological measures; b. have only a limited commercially significant purpose or use other than the circumvention of effective technological measures; or c. are primarily designed, manufactured, adapted or performed for the purpose of enabling or facilitating the circumvention of effective technological measures.

The ban on circumvention may not be enforced against those persons who undertake the circumvention exclusively for legally permitted uses.

Wirksame technische Massnahmen zum Schutz von Werken und anderen Schutzobjekten dürfen nicht umgangen werden.

Als wirksame technische Massnahmen im Sinne von Absatz 1 gelten Technologien und Vorrichtungen wie Zugangs- und Kopierkontrollen, Verschlüsselungs-, Verzerrungs- und andere Umwandlungsmechanismen, die dazu bestimmt und geeignet sind, unerlaubte Verwendungen von Werken und anderen Schutzobjekten zu verhindern oder einzuschränken.

Verboten sind das Herstellen, Einführen, Anbieten, Veräussern oder das sonstige Verbreiten, Vermieten, Überlassen zum Gebrauch, die Werbung für und der Besitz zu Erwerbszwecken von Vorrichtungen, Erzeugnissen oder Bestandteilen sowie das Erbringen von Dienstleistungen, die: a. Gegenstand einer Verkaufsförderung, Werbung oder Vermarktung mit dem Ziel der Umgehung wirksamer technischer Massnahmen sind; b. abgesehen von der Umgehung wirksamer technischer Massnahmen nur einen begrenzten wirtschaftlichen Zweck oder Nutzen haben; oder c. hauptsächlich entworfen, hergestellt, angepasst oder erbracht werden, um die Umgehung wirksamer technischer Massnahmen zu ermöglichen oder zu erleichtern.

Das Umgehungsverbot kann gegenüber denjenigen Personen nicht geltend gemacht werden, welche die Umgehung ausschliesslich zum Zweck einer gesetzlich erlaubten Verwendung vornehmen.

Il est interdit de contourner les mesures techniques efficaces servant à la protection des œuvres et d’autres objets protégés.

Sont considérées comme des mesures techniques efficaces au sens de l’al. 1 les technologies et les dispositifs tels que les contrôles d’accès, les protections anticopies, le cryptage, le brouillage et les autres mécanismes de transformation destinés et propres à empêcher ou à limiter les utilisations non autorisées d’œuvres et d’autres objets protégés.

Il est interdit de fabriquer, d’importer, de proposer au public, d’aliéner ou de mettre en circulation de quelque autre manière, de louer, de confier pour usage, de faire de la publicité pour, de posséder dans un but lucratif des dispositifs, des produits ou des composants ainsi que de fournir des services qui présentent une des caractéristiques suivantes: a. ils font l’objet d’une promotion, d’une publicité ou d’une commercialisation visant à contourner des mesures techniques efficaces; b. ils n’ont, le contournement de mesures techniques efficaces mis à part, qu’une finalité ou une utilité commerciale limitée; c. ils sont principalement conçus, produits, adaptés ou réalisés dans le but de permettre ou de faciliter le contournement des mesures techniques efficaces.

L’interdiction de contourner ne peut pas frapper celui qui contourne une mesure technique efficace exclusivement dans le but de procéder à une utilisation licite.

I provvedimenti tecnici efficaci destinati alla protezione delle opere e di altri oggetti protetti non devono essere elusi.

Sono considerati provvedimenti tecnici efficaci ai sensi del capoverso 1 le tecnologie e i dispositivi quali i controlli relativi all’accesso e alle copie, i sistemi di criptaggio, i sistemi di distorsione e altri sistemi di trasformazione destinati e atti a impedire o limitare impieghi non autorizzati di opere e di altri oggetti protetti.

È vietato produrre, importare, offrire al pubblico, alienare o mettere altrimenti in circolazione, dare in locazione, lasciare in uso, pubblicizzare o possedere a scopo di lucro dispositivi, prodotti o componenti e fornire servizi che: a. sono oggetto di un’azione promozionale, pubblicitaria o commerciale volta a eludere i provvedimenti tecnici efficaci; b. a prescindere dall’elusione dei provvedimenti tecnici efficaci, hanno solo una finalità o utilità commerciale limitata; o c. sono progettati, prodotti, adattati o forniti principalmente allo scopo di consentire o facilitare l’elusione dei provvedimenti tecnici efficaci.

Il divieto di elusione non può essere fatto valere nei confronti di chi elude i provvedimenti tecnici efficaci esclusivamente allo scopo di procedere a un’utilizzazione legalmente autorizzata.
