Every test purchase is based on a test concept established by the competent cantonal authority.

The test concept includes at least explanations on: a. the applicable legal basis; b. the recruitment of minors; c. the confidentiality obligation of the minor and the accompanying adult regarding the tested points of sale and the results of test purchases; d. the planning and preparation of test purchases; e. the conduct of test purchases; f. the minutes and documentation of test purchases; g. the communication of results to the concerned points of sale; h. the procedure to follow in case of an infringement; i. the preservation and destruction of data.

Jeder Testkauf stützt sich auf ein von der zuständigen kantonalen Behörde festgelegtes Testkonzept ab.

Das Testkonzept beinhaltet mindestens Erläuterungen betreffend: a. die anwendbaren Rechtsgrundlagen; b. die Rekrutierung von Minderjährigen; c. die Geheimhaltungspflicht der minderjährigen Person und der erwachsenen Person, die diese begleitet, in Bezug auf die getesteten Verkaufsstellen und die Ergebnisse der Testkäufe; d. die Planung und Vorbereitung der Testkäufe; e. den Ablauf der Testkäufe; f. die Protokollierung und die Dokumentation der Testkäufe; g. die Rückmeldungen der Resultate an die betroffenen Verkaufsstellen; h. das zu befolgende Verfahren bei einem Verstoss; i. die Aufbewahrung und Vernichtung der Daten.

Le concept de test comprend au moins des explications sur: a. les bases légales applicables; b. le recrutement des mineurs; c. le devoir de confidentialité du mineur et de l’adulte qui l’accompagne concernant les points de vente testés et les résultats des achats tests; d. la planification et la préparation des achats tests; e. le déroulement des achats tests; f. le procès-verbal et la documentation des achats tests; g. la communication des résultats aux points de vente concernés; h. la procédure à suivre en cas d’infraction; i. la conservation et la destruction des données.

Il piano dei test comprende almeno spiegazioni concernenti: a. le basi legali applicabili; b. il reclutamento dei minorenni; c. l’obbligo di confidenzialità del minorenne e dell’adulto che lo accompagna in merito ai punti di vendita sottoposti al test e ai risultati dei test d’acquisto; d. la pianificazione e la preparazione dei test d’acquisto; e. lo svolgimento dei test d’acquisto; f. la verbalizzazione e la documentazione dei test d’acquisto; g. la comunicazione dei risultati ai punti di vendita interessati; h. la procedura da seguire in caso d’infrazione; i. la conservazione e la distruzione dei dati.
