Every telecommunications service provider shall have a right of access to the building entry point and of joint use of the installations within the building intended for telecommunications transmission provided this is technically justifiable and there is no other good cause for refusal.

Building owners and telecommunications service providers must allow the joint use of the installations within the building in a transparent and non-discriminatory manner.

Building owners and shall make the required information on the installations within the building available to the providers on request.

Providers who have financed an installation must be compensated appropriately.

If requested to do so, ComCom shall rule on disputes between telecommunications service providers relating to access to the building entry point or the conditions for joint use. Article 11 b applies by analogy.

Jede Anbieterin von Fernmeldediensten hat das Recht auf Zugang zum Gebäudeeinführungspunkt und auf Mitbenutzung der für die fernmeldetechnische Übertragung bestimmten gebäudeinternen Anlagen, soweit dies technisch vertretbar ist und keine anderen wichtigen Gründe für eine Verweigerung vorliegen.

Liegenschaftseigentümerinnen und -eigentümer sowie Anbieterinnen von Fernmeldediensten haben die Mitbenutzung der gebäudeinternen Anlagen auf transparente und nicht diskriminierende Weise zu gewähren.

Die Liegenschaftseigentümerinnen und -eigentümer stellen den Anbieterinnen auf Anfrage die erforderlichen Informationen zu den gebäudeinternen Anlagen zur Verfügung.

Anbieterinnen, die eine Anlage finanziert haben, sind angemessen zu entschädigen.

Die ComCom entscheidet über Streitigkeiten zwischen Anbieterinnen von Fernmeldediensten betreffend den Zugang zum Gebäudeeinführungspunkt oder die Bedingungen der Mitbenutzung auf Gesuch hin. Artikel 11 b gilt sinngemäss.

Nella misura in cui è tecnicamente possibile e in assenza di altri motivi importanti che giustifichino il rifiuto, ogni fornitore di servizi di telecomunicazione ha il diritto di accedere al punto d’entrata nell’edificio e di utilizzare in comune gli impianti domestici atti alla trasmissione d’informazioni mediante telecomunicazione.

Il proprietario dell’immobile e i fornitori di servizi di telecomunicazione sono tenuti a permettere la coutenza degli impianti domestici in modo trasparente e non discriminatorio.

Il proprietario dell’immobile deve dare ai fornitori che ne fanno domanda le informazioni necessarie relative agli impianti domestici.

I fornitori che hanno finanziato gli impianti devono essere indennizzati in modo adeguato.

Su richiesta, la ComCom decide in merito a controversie tra fornitori di servizi di telecomunicazione riguardanti l’accesso al punto d’entrata nell’edificio o le condizioni di coutenza. L’articolo 11 b si applica per analogia.
