The appeal body shall be independent in its adjudication and bound only by the law.

The members may not belong to the body responsible for the admission of securities to trading, nor may they be in an employment relationship or any other contractual relationship with the trading venue that could lead to conflicts of interest.

The provisions of the Federal Supreme Court Act of 17 June 2005 {note: SR 173.110} on recusal apply to the members of the independent appeal body.

The regulations concerning the independent appeal body shall contain guidelines with respect to composition, election, organisation and proceedings before the appeal body.

Die Beschwerdeinstanz ist in ihrer rechtsprechenden Tätigkeit unabhängig und nur dem Recht verpflichtet.

Die Mitglieder dürfen weder der Stelle für die Zulassung von Effekten zum Handel angehören noch in einem Arbeitsverhältnis oder einem anderen Vertragsverhältnis mit dem Handelsplatz stehen, das zu Interessenkonflikten führt.

Für die Mitglieder der unabhängigen Beschwerdeinstanz gelten die Ausstandbestimmungen des Bundesgerichtsgesetzes vom 17. Juni 2005 {note: SR 173.110} .

Das Reglement über die unabhängige Beschwerdeinstanz enthält Vorschriften betreffend Zusammensetzung, Wahl, Organisation und Verfahren vor der Beschwerdeinstanz.

Dans l’exercice de ses attributions légales, l’instance de recours est indépendante et n’est soumise qu’à la loi.

Ses membres ne doivent pas faire partie de l’organe chargé de l’admission des valeurs mobilières à la négociation ni entretenir de rapports de travail ou d’autres rapports contractuels susceptibles d’engendrer des conflits d’intérêts avec la plate-forme de négociation.

Les dispositions sur la récusation énoncées dans la loi du 17 juin 2005 sur le Tribunal fédéral {note: RS 173.110} s’appliquent aux membres de l’instance de recours indépendante.

Le règlement de l’instance de recours indépendante comprend des dispositions sur la composition, la nomination, l’organisation et les procédures de cette instance.

Nella sua attività giurisdizionale l’autorità di ricorso è indipendente e sottostà al solo diritto.

I suoi membri non possono far parte dell’organo per l’ammissione di valori mobiliari al commercio né avere un rapporto di lavoro o un altro rapporto contrattuale con la sede di negoziazione che generi conflitti di interessi.

Ai membri dell’autorità indipendente di ricorso si applicano le disposizioni sulla ricusazione della legge del 17 giugno 2005 {note: RS 173.110} sul Tribunale federale.

Il regolamento dell’autorità indipendente di ricorso contiene prescrizioni concernenti la composizione, la nomina, l’organizzazione e le procedure di tale autorità.
