Any person who wilfully does any of the following is liable to a fine of up to CHF 20,000 unless Article 26 is applicable: {note: Amended by No I of the FA of 15 June 2012, in force since 1 Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} a. disregards the regulations on housing animals; b. violates the regulations on breeding or producing animals; c. violates the regulations on producing, breeding, housing, trading in or using genetically modified animals; d. violates the regulations on the transport of animals; e. violates the regulations on interventions involving animals or animal experiments; f. violates the regulations on the slaughter of animals; g. performs other acts on animals that are forbidden by this Act or the Ordinance; h. {note: Inserted by No I of the FA of 15 June 2012, in force since 1 Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} trades in animals in contravention of the regulations; i. {note: Inserted by No I of the FA of 15 June 2012, in force since 1 Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} uses living animals for advertising in contravention of the regulations.

Attempts, complicity and incitement are also offences. If the offender has acted through negligence, he or she is liable to a fine. {note: Amended by No I of the FA of 15 June 2012, in force since 1 Jan. 2013 ( AS 2012 6279; BBl 2011 7055).}

Any person who, wilfully or through negligence, violates an implementation provision, contravention of which has been deemed to be an offence, or a ruling of which he or she has been notified that carries the sanctions provided for in this Article is liable to a fine. {note: Amended by No I of the FA of 15 June 2012, in force since 1 Jan. 2013 ( AS 2012 6279; BBl 2011 7055).}

Mit Busse bis zu 20 000 Franken wird bestraft, sofern nicht Artikel 26 anwendbar ist, wer vorsätzlich: {note: Fassung gemäss Ziff. I des BG vom 15. Juni 2012, in Kraft seit 1. Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} a. die Vorschriften über die Tierhaltung missachtet; b. Tiere vorschriftswidrig züchtet oder erzeugt; c. vorschriftswidrig gentechnisch veränderte Tiere erzeugt, züchtet, hält, mit ihnen handelt oder sie verwendet; d. Tiere vorschriftswidrig befördert; e. vorschriftswidrig Eingriffe am Tier oder Tierversuche vornimmt; f. Tiere vorschriftswidrig schlachtet; g. andere durch das Gesetz oder die Verordnung verbotene Handlungen an Tieren vornimmt; h. {note: Eingefügt durch Ziff. I des BG vom 15. Juni 2012, in Kraft seit 1. Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} vorschriftswidrig gewerbsmässig mit Tieren handelt; i. {note: Eingefügt durch Ziff. I des BG vom 15. Juni 2012, in Kraft seit 1. Jan. 2013 ( AS 2012 6279; BBl 2011 7055).} vorschriftswidrig lebende Tiere zur Werbung verwendet.

Versuch, Gehilfenschaft und Anstiftung sind strafbar. Handelt die Täterin oder der Täter fahrlässig, so ist die Strafe Busse. {note: Fassung gemäss Ziff. I des BG vom 15. Juni 2012, in Kraft seit 1. Jan. 2013 ( AS 2012 6279; BBl 2011 7055).}

Mit Busse wird bestraft, wer vorsätzlich oder fahrlässig gegen eine Ausführungsvorschrift, deren Missachtung für strafbar erklärt worden ist, oder eine unter Hinweis auf die Strafandrohung dieses Artikels an ihn gerichtete Verfügung verstösst. {note: Fassung gemäss Ziff. Sous réserve de l’art. 26, est puni d’une amende de 20 000 francs au plus quiconque, intentionnellement: {note: Nouvelle teneur selon le ch. I de la LF du 15 juin 2012, en vigueur depuis le 1 er janv. 2013 ( RO 2012 6279; FF 2011 6505).} contrevient aux dispositions concernant le commerce d’animaux à titre professionnel; i. {note: Introduite par le ch. I de la LF du 15 juin 2012, en vigueur depuis le 1 er janv. 2013 ( RO 2012 6279; FF 2011 6505).} contrevient aux dispositions concernant l’utilisation d’animaux vivants à des fins publicitaires.

La tentative, la complicité et l’instigation sont punissables. Si l’auteur agit par négligence, il est puni de l’amende. {note: Nouvelle teneur selon le ch. I de la LF du 15 juin 2012, en vigueur depuis le 1 er janv. 2013 ( RO 2012 6279; FF 2011 6505).}

Est puni d’une amende quiconque, intentionnellement ou par négligence, contrevient à une disposition d’exécution dont la violation a été déclarée punissable ou à une décision qui lui a été signifiée sous la menace de la peine prévue au présent article. {note: Nouvelle teneur selon le ch. È punito con la multa sino a 20 000 franchi, sempre che non sia applicabile l’articolo 26, chiunque intenzionalmente: {note: Nuovo testo giusta il n. I della LF del 15 giu. 2012, in vigore dal 1° gen. 2013 ( RU 2012 6279; FF 2011 6287).} a. viola le prescrizioni sulla detenzione di animali; b. viola le prescrizioni sull’allevamento o la produzione di animali; c. viola le prescrizioni sulla produzione, l’allevamento, la detenzione, il commercio o l’utilizzazione di animali geneticamente modificati; d. viola le prescrizioni sul trasporto di animali; e. viola le prescrizioni concernenti gli interventi su animali o gli esperimenti sugli animali; f. viola le prescrizioni sulla macellazione di animali; g. intraprende con gli animali altre pratiche vietate dalla legge o dall’ordinanza; h. {note: Introdotta dal n. I della LF del 15 giu. 2012, in vigore dal 1° gen. 2013 ( RU 2012 6279; FF 2011 6287).} viola le prescrizioni sul commercio professionale di animali; i. {note: Introdotta dal n. I della LF del 15 giu. 2012, in vigore dal 1° gen. 2013 ( RU 2012 6279; FF 2011 6287).} viola le prescrizioni sull’utilizzazione di animali vivi per la pubblicità.

È punito con la multa chiunque, intenzionalmente o per negligenza, contravviene a una prescrizione d’esecuzione la cui inosservanza è stata dichiarata punibile oppure a una decisione notificatagli sotto comminatoria della pena prevista nel presente articolo. {note: Nuovo testo giusta il n.
