Anyone who intentionally places on the market or makes available on the market a construction product that does not meet the requirements set forth in this law and thereby endangers the safety or health of persons shall be punished with a custodial sentence of up to one year or with a monetary penalty.
If the perpetrator acts in the course of business, they shall be punished with a custodial sentence of up to three years or with a monetary penalty.
If the perpetrator acts negligently, they shall be punished with a monetary penalty of up to 180 daily penalty units.
Forgery, false certification, fraudulent obtaining of a false certification, use of false or inaccurate attestations, unauthorized establishment of performance declarations, as well as unauthorized affixing and use of conformity markings within the meaning of Articles 23 to 28 of the Federal Law of October 6, 1995, on Technical Barriers to Trade, are punished in accordance with these same articles.
Wer vorsätzlich ein Bauprodukt in Verkehr bringt oder auf dem Markt bereitstellt, das die Anforderungen dieses Gesetzes nicht erfüllt, und dadurch die Sicherheit oder Gesundheit von Personen gefährdet, wird mit Freiheitsstrafe bis zu einem Jahr oder mit Geldstrafe bestraft.
Handelt die Täterin oder der Täter gewerbsmässig, so ist die Strafe Freiheitsstrafe bis zu drei Jahren oder Geldstrafe.
Handelt die Täterin oder der Täter fahrlässig, so ist die Strafe Geldstrafe bis zu 180 Tagessätzen.
Für Fälschungen, Falschbeurkundungen, das Erschleichen falscher Beurkundungen, den Gebrauch unechter oder unwahrer Bescheinigungen, das unberechtigte Ausstellen von Leistungserklärungen sowie das unberechtigte Anbringen und Verwenden von Konformitätszeichen im Sinne der Artikel 23–28 des Bundesgesetzes vom 6. Oktober 1995 {note: SR 946.51} über die technischen Handelshemmisse gelten die dort genannten Strafandrohungen.
Quiconque, intentionnellement, met sur le marché ou met à disposition sur le marché un produit de construction qui ne satisfait pas aux exigences fixées dans la présente loi et met ainsi en danger la sécurité ou la santé des personnes est puni d’une peine privative de liberté d’un an au plus ou d’une peine pécuniaire.
Si l’auteur agit par métier, il est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire.
Si l’auteur agit par négligence, il est puni d’une peine pécuniaire de 180 jours-amende au plus.
Le faux, la constatation fausse, l’obtention frauduleuse d’une constatation fausse, l’utilisation d’attestations fausses ou inexactes, l’établissement non autorisé de déclarations des performances de même que l’apposition et l’utilisation non autorisées de signes de conformité au sens des art. 23 à 28 de la loi fédérale du 6 octobre 1995 sur les entraves techniques au commerce {note: RS 946.51} sont réprimés selon ces mêmes articles.
Chiunque intenzionalmente immette in commercio o mette a disposizione sul mercato un prodotto da costruzione che non soddisfa i requisiti definiti nella presente legge e in tal modo mette in pericolo la sicurezza o la salute delle persone, è punito con una pena detentiva fino a un anno o con una pena pecuniaria.
Se l’autore ha agito per mestiere, la pena è una pena detentiva fino a tre anni o una pena pecuniaria.
Se l’autore ha agito per negligenza, la pena è una pena pecuniaria fino a 180 aliquote giornaliere.
Per falsificazioni, false attestazioni, conseguimento fraudolento di false attestazioni, uso di attestazioni false o inesatte, rilascio non autorizzato di dichiarazioni di prestazione, applicazione e uso non autorizzato di marchi di conformità ai sensi degli articoli 23–28 della legge federale del 6 ottobre 1995 {note: RS 946.51} sugli ostacoli tecnici al commercio sono applicabili le pene ivi menzionate.
