Whoever, with the intent to deceive others in business relations, shall be punished with a custodial sentence of up to three years or a monetary penalty: a. uses or allows the use of false or incorrect accreditation, testing, conformity, or approval certifications created by a third party; b. fraudulently asserts an accreditation, testing, conformity, and approval certification in any manner other than those provided for in let. a and Arts. 23 to 25.

Mit Freiheitsstrafe bis zu drei Jahren oder Geldstrafe wird bestraft, wer zur Täuschung im Rechtsverkehr: {note: Fassung gemäss Art. 333 des Strafgesetzbuches in der Fassung des BG vom 13. Dez. 2002, in Kraft seit 1. Jan. 2007 ( AS 2006 3459; BBl 1999 1979).} a. von einem Dritten hergestellte unechte oder unwahre Akkreditierungs‑, Prüf‑, Konformitäts- oder Zulassungsbescheinigungen gebraucht oder gebrauchen lässt; b. auf andere Weise als nach den in Buchstabe a und in den Artikeln 23–25 aufgeführten Tatbeständen das Vorhandensein einer Akkreditierungs‑, Prüf‑, Konformitäts- oder Zulassungsbescheinigung vorgibt.

Est puni d’une peine privative de liberté de trois ans au plus ou d’une peine pécuniaire quiconque, pour tromper autrui dans les relations d’affaires: a. utilise ou laisse utiliser des attestations d’accréditation, d’essais, de conformité ou d’homologation fausses ou inexactes faites par un tiers; b. fait valoir frauduleusement une attestation d’accréditation, d’essais, de conformité et d’homologation de toute autre manière que celles prévues à la let. a et aux art. 23 à 25.

È punito con una pena detentiva sino a tre anni o con una pena pecuniaria chiunque a scopo d’inganno, nelle relazioni giuridiche: {note: Nuovo testo giusta l’art. 333 del Codice penale, nel testo della LF del 13 dic. 2002, in vigore dal 1° gen. 2007 ( RU 2006 3459; FF 1999 1787).} a. fa uso o tollera che altri facciano uso di certificati d’accreditamento, d’esame, di conformità e d’omologazione falsi o inesatti redatti da un terzo; b. fa valere in modo fraudolento un certificato d’accreditamento, d’esame, di conformità e d’omologazione in altro modo rispetto a quanto previsto nella lettera a e negli articoli 23 a 25.
