A postgraduate training program leading to the award of a federal postgraduate title shall be accredited under the following conditions: a. it is under the responsibility of a national professional association or another appropriate organization (responsible organization); b. it enables trainees to achieve the postgraduate training objectives set out in this law; c. it is open to individuals from all over Switzerland; d. it is based on university education; e. it makes it possible to determine whether or not trainees have achieved the objectives set out in Art. 17; f. it includes both practical training and theoretical instruction; g. it ensures that the postgraduate training is conducted under the responsibility of a holder of a corresponding federal postgraduate title; h. the postgraduate training is provided in postgraduate training institutions recognized for this purpose by the responsible organization; i. it requires trainees to provide personal collaboration and to assume responsibilities; j. the responsible organization has an independent and impartial body responsible for ruling on appeals by trainees or postgraduate training institutions, according to a fair procedure, at least in the cases provided for in Art. 55.

The Federal Council, after consulting the Medical Professions Commission and the responsible organizations, may issue provisions that concretize the accreditation criterion referred to in para. 1, let. b.

A single organization is responsible for all the postgraduate training programs provided for each university medical profession.

Ein Weiterbildungsgang, der zu einem eidgenössischen Weiterbildungstitel führen soll, wird akkreditiert, wenn: a. er unter der Verantwortung einer gesamtschweizerischen Berufsorganisation oder einer anderen geeigneten Organisation steht (verantwortliche Organisation); b. er es den Personen in Weiterbildung erlaubt, die Weiterbildungsziele nach diesem Gesetz zu erreichen; c. er Personen aus der ganzen Schweiz zugänglich ist; d. er auf die universitäre Ausbildung aufbaut; e. er erlaubt zu beurteilen, ob die Personen in Weiterbildung die Ziele nach Artikel 17 erreicht haben oder nicht; f. er sowohl praktische Ausbildung als auch theoretischen Unterricht umfasst; g. er gewährleistet, dass die Weiterbildung unter der Verantwortung einer Inhaberin oder eines Inhabers eines entsprechenden eidgenössischen Weiterbildungstitels erfolgt; h. er in Weiterbildungsstätten angeboten wird, die von der verantwortlichen Organisation zu diesem Zweck anerkannt worden sind; i. er von den Personen in Weiterbildung persönliche Mitarbeit und die Übernahme von Verantwortung verlangt; j. die verantwortliche Organisation eine unabhängige und unparteiische Instanz hat, welche über Beschwerden der Personen in Weiterbildung oder der Weiterbildungsstätten in einem fairen Verfahren mindestens in den Fällen nach Artikel 55 entscheidet.

Der Bundesrat kann nach Anhörung der Medizinalberufekommission und der verantwortlichen Organisationen Bestimmungen erlassen, welche das Akkreditierungskriterium gemäss Absatz 1 Buchstabe b konkretisieren.

Für jeden universitären Medizinalberuf ist eine einzige Organisation für alle vorgesehenen Weiterbildungsgänge verantwortlich.

Une filière de formation postgrade devant mener à l’obtention d’un titre postgrade fédéral est accréditée aux conditions suivantes: a. elle est sous la responsabilité d’une association professionnelle nationale ou d’une autre organisation appropriée (organisation responsable); b. elle permet aux personnes en formation d’atteindre les objectifs de la formation postgrade fixés dans la présente loi; c. elle est ouverte à des personnes venant de toute la Suisse; d. elle se fonde sur la formation universitaire; e. elle permet de déterminer si les personnes en formation ont atteint ou non les objectifs visés à l’art. 17; f. elle comprend tant une formation pratique qu’un enseignement théorique; g. elle garantit que la formation postgrade se déroule sous la responsabilité d’un titulaire d’un titre postgrade fédéral correspondant; h. la formation postgrade est dispensée dans des établissements de formation postgrade reconnus à cet effet par l’organisation responsable; i. elle requiert des personnes en formation qu’elles fournissent une collaboration personnelle et qu’elles assument des responsabilités; j. l’organisation responsable dispose d’une instance indépendante et impartiale chargée de statuer sur les recours des personnes en formation ou des établissements de formation postgrade, selon une procédure équitable, au moins dans les cas prévus à l’art. 55.

Le Conseil fédéral, après avoir consulté la Commission des professions médicales et les organisations responsables, peut édicter des dispositions qui concrétisent le critère d’accréditation visé à l’al. 1, let. b.

Une seule organisation est responsable de toutes les filières de formation postgrade prévues pour chaque profession médicale universitaire.

Un ciclo di perfezionamento finalizzato all’ottenimento di un titolo federale di perfezionamento è accreditato se: a. si svolge sotto la responsabilità di un’organizzazione professionale a carattere nazionale o di un’altra organizzazione idonea (organizzazione responsabile); b. consente alle persone che lo frequentano di raggiungere gli obiettivi di perfezionamento secondo la presente legge; c. è aperto a persone provenienti da tutta la Svizzera; d. è impostato sulla formazione universitaria; e. consente di accertare se le persone che lo frequentano hanno raggiunto gli obiettivi di cui all’articolo 17; f. include sia una formazione pratica sia un insegnamento teorico; g. garantisce che il perfezionamento si svolga sotto la responsabilità di una persona in possesso del titolo federale di perfezionamento corrispondente; h. si svolge in centri autorizzati a questo scopo dall’organizzazione responsabile; i. richiede dalle persone che lo frequentano collaborazione personale e assunzione di responsabilità; j. l’organizzazione responsabile dispone di un’istanza indipendente e imparziale incaricata di statuire sui ricorsi delle persone che lo frequentano o dei centri di perfezionamento, secondo una procedura equa, almeno nei casi di cui all’articolo 55.

Dopo aver consultato la Commissione delle professioni mediche e le organizzazioni responsabili, il Consiglio federale può emanare disposizioni che concretizzano il criterio di accreditamento di cui al capoverso 1 lettera b.

Per ciascuna professione medica universitaria, un’unica organizzazione è responsabile per tutti i cicli di perfezionamento previsti.
