Si la perception d’émoluments en vertu de l’al. 1 ou 3 paraît inappropriée en raison des circonstances, fedpol peut réduire ces derniers ou les supprimer complètement.

Se durante un controllo a campione presso un punto vendita sono state constatate irregolarità, per l’esecuzione del controllo e per eventuali controlli successivi fedpol riscuote emolumenti tra i 200 e i 500 franchi per controllo.

La riscossione di emolumenti per i controlli eseguiti dai Cantoni durante i quali sono state constatate irregolarità è retta dal diritto cantonale.

Per il deposito e lo smaltimento di precursori e di sostanze esplodenti confiscati fedpol riscuote gli emolumenti seguenti: a. per piccoli quantitativi: 100 franchi; b. per quantitativi più elevati: l’emolumento corrisponde alle spese effettive.

La riscossione di emolumenti per il deposito e lo smaltimento di precursori e di sostanze esplodenti è retta dal diritto cantonale se la confisca è stata eseguita da un Cantone.

Se, considerate le circostanze, la riscossione di emolumenti ai sensi del capoverso 1 o 3 sembra inopportuna, fedpol può ridurre l’emolumento o rinunciare completamente a riscuoterlo.
