SECO shall refuse to allow transit where there are grounds for refusal in accordance with Article 6 GCA.

It shall also refuse to allow the transit of goods in accordance with Annexes 2–5 if no licence for export from the country of origin or the supplying state to the final destination state is produced.

Proof that the goods have been supplied legally must be provided on the entry of the goods into Swiss customs territory.

Paragraphs 2 and 3 do not apply to: a. goods intended for a state that is listed in Annex 7; b. state-employed security agents on pre-arranged official transit journeys, provided their firearms with the ammunition pertaining thereto are carried though in transit; c. air passengers who stopover in Switzerland and who carry with them in their baggage weapons for personal use in accordance with Article 4 WA, their parts and components and accessories, or ammunition and munitions parts and components, provided these goods do not leave the transit area of the airport; the foregoing also applies to baggage that is sent in advance or subsequently forwarded.

Release from a public warehouse, a warehouse for bulk goods or a bonded warehouse is deemed equivalent to transit.

Das SECO verweigert eine Durchfuhr, wenn Verweigerungsgründe nach Artikel 6 GKG vorliegen.

Es verweigert auch die Durchfuhr für Güter nach den Anhängen 2–5, wenn keine Ausfuhrbewilligung des Ursprungsstaats oder des Lieferstaats für den definitiven Bestimmungsstaat vorliegt.

Der Nachweis über den rechtmässigen Versand ist beim Eintritt der Güter in das schweizerische Zollgebiet zu erbringen.

Die Absätze 2 und 3 sind nicht anwendbar auf: a. Güter, die für einen Staat bestimmt sind, der in Anhang 7 aufgeführt ist; b. staatlich beauftragte Sicherheitsbegleiterinnen und -begleiter auf angemeldeten offiziellen Durchreisen, wenn sie ihre Feuerwaffen mit dazugehöriger Munition durchführen; c. Flugreisende, die in der Schweiz zwischenlanden und die für den persönlichen Gebrauch im Reisegepäck Waffen nach Artikel 4 WG, deren Bestandteile und Zubehör sowie Munition und Munitionsbestandteile dazu mitführen, wenn diese Güter den Transitbereich des Flughafens nicht verlassen; dies gilt auch für voraus- oder nachgesandtes Reisegepäck.

Der Durchfuhr gleichgestellt ist die Auslagerung aus einem offenen Zolllager, einem Lager für Massengüter oder einem Zollfreilager.

Il refuse également le transit de biens mentionnés aux annexes 2 à 5 en l’absence de permis d’exportation de l’État d’origine ou de l’État fournisseur pour l’État de destination finale.

La preuve de l’expédition juridiquement conforme doit être apportée lors de l’entrée des biens sur le territoire douanier suisse.

Les al. 2 et 3 ne sont pas applicables: a. aux biens destinés à un État mentionné à l’annexe 7; b. aux agents de sécurité mandatés par un État, en transit lors de visites officielles annoncées et en possession de leurs armes à feu et de munitions; c. aux personnes voyageant par avion qui transitent par la Suisse avec, dans leurs bagages, des armes visées à l’art. 4 LArm pour leur usage personnel, ainsi que leurs composants et accessoires, leurs munitions et composants de munitions, pour autant que ces biens ne quittent pas la zone de transit de l’aéroport; cette règle s’applique aussi aux bagages expédiés à l’avance ou que l’on fait suivre.

La sortie d’un entrepôt douanier ouvert, d’un entrepôt de marchandises de grande consommation ou d’un dépôt franc sous douane est assimilée à un transit.

La SECO rifiuta il transito qualora sussistano i motivi di rifiuto di cui all’articolo 6 LBDI.

Essa rifiuta altresì il transito dei beni di cui agli allegati 2–5 in assenza di un’autorizzazione d’esportazione dello Stato d’origine o dello Stato che fornisce i beni per lo Stato di destinazione definitivo.

La prova della fornitura giuridicamente conforme deve essere addotta al momento dell’entrata dei beni nel territorio doganale svizzero.

I capoversi 2 e 3 non si applicano: a. ai beni destinati a uno Stato elencato nell’allegato 7; b. agli agenti di scorta incaricati da uno Stato, in transito in occasione di visite ufficiali annunciate e in possesso di armi da fuoco e delle relative munizioni; c. a persone che viaggiano in aereo e fanno scalo intermedio in Svizzera e che, nei bagagli, portano con sé per uso personale armi di cui all’articolo 4 LArm, relative parti e accessori, nonché munizioni o elementi di munizioni, sempreché queste merci non lascino la zona di transito dell’aeroporto; questo disciplinamento si applica anche ai bagagli spediti in precedenza o in seguito.

L’uscita da un deposito doganale aperto, da un deposito di merci di gran consumo o da un deposito franco doganale è parificata al transito.
