Coercive measures may be taken only under the following conditions: a. they are provided for by law; b. sufficient suspicions justify an assumption of an offense; c. the objectives pursued cannot be achieved by less severe measures; d. they appear justified in relation to the seriousness of the offense.

Coercive measures that infringe on the fundamental rights of persons who do not have the status of accused are applied with particular restraint.

Zwangsmassnahmen können nur ergriffen werden, wenn: a. sie gesetzlich vorgesehen sind; b. ein hinreichender Tatverdacht vorliegt; c. die damit angestrebten Ziele nicht durch mildere Massnahmen erreicht werden können; d. die Bedeutung der Straftat die Zwangsmassnahme rechtfertigt.

Zwangsmassnahmen, die in die Grundrechte nicht beschuldigter Personen eingreifen, sind besonders zurückhaltend einzusetzen.

Les mesures de contrainte ne peuvent être prises qu’aux conditions suivantes: a. elles sont prévues par la loi; b. des soupçons suffisants laissent présumer une infraction; c. les buts poursuivis ne peuvent pas être atteints par des mesures moins sévères; d. elles apparaissent justifiées au regard de la gravité de l’infraction.

Les mesures de contrainte qui portent atteinte aux droits fondamentaux des personnes qui n’ont pas le statut de prévenu sont appliquées avec une retenue particulière.

Possono essere adottati provvedimenti coercitivi soltanto se: a. sono previsti dalla legge; b. vi sono sufficienti indizi di reato; c. gli obiettivi con essi perseguiti non possono essere raggiunti mediante misure meno severe; d. l’importanza del reato li giustifica.

I provvedimenti coercitivi che incidono sui diritti fondamentali di chi non è imputato vanno adottati con particolare cautela.
