The Commercial Registry Office generally directs the applicant to the first-instance authority (Art. 18, para. 1) only if the registration in the commercial register is related to the participation of a person abroad in a company without legal personality but having the capacity to acquire, or to a legal entity whose real purpose is the acquisition of real estate (Art. 4, para. 1, lett. b and e of the AREL; Art. 1, para. 1, lett. a and b) which is not exempt from the authorization requirement under the meaning of Art. 2, para. 2, lett. a, AREL.

Das Handelsregisteramt verweist die anmeldende Person in der Regel nur dann an die Bewilligungsbehörde (Art. 18 Abs. 1), wenn die Eintragung in das Handelsregister im Zusammenhang mit einer Beteiligung einer Person im Ausland an einer vermögensfähigen Gesellschaft ohne juristische Persönlichkeit oder an einer juristischen Person steht, deren tatsächlicher Zweck der Erwerb von Grundstücken ist (Art. 4 Abs. 1 Bst. b und e BewG; Art. 1 Abs. 1 Bst. a und b), die nicht nach Artikel 2 Absatz 2 Buchstabe a BewG ohne Bewilligung erworben werden können.

L’office du registre du commerce, en règle générale, ne renvoie le requérant à l’autorité de première instance (art. 18, al. 1) que si l’inscription au registre du commerce est en rapport avec la participation d’une personne à l’étranger à une société sans personnalité juridique mais ayant la capacité d’acquérir ou à une personne morale qui ont pour but réel l’acquisition d’immeubles (art. 4. al. 1, let. b et e, LFAIE; art. 1, al. 1, let. a et b) qui n’est pas soustraite au régime de l’autorisation au sens de l’art. 2, al. 2, let. a, LFAIE.

L’ufficio del registro di commercio rinvia il richiedente all’autorità di prima istanza (art. 18 cpv. 1) di regola solamente se l’iscrizione nel registro di commercio è legata alla partecipazione di una persona all’estero ad una società senza personalità giuridica ma con capacità patrimoniale oppure ad una persona giuridica, il cui scopo effettivo è l’acquisto di fondi (art. 4 cpv. 1 lett. b ed e LAFE; art. 1 cpv. 1 lett. a e b) che non possono essere acquistati senza autorizzazione in virtù dell’articolo 2 capoverso 2 lettera a LAFE.
