The restitution of confiscated assets is made through the financing of programmes of public interest.

The Federal Council may conclude agreements governing the restitution of assets.

Such agreements may cover, in particular: a. the type of programmes of public interest to be funded by the returned assets; b. the way in which the returned assets are to be used; c. the parties to be included in the restitution process; d. control and monitoring of the use made of the returned assets.

In the absence of an agreement with the country of origin, the Federal Council shall determine the process of restitution. It may, in particular, return confiscated assets via international or national organisations, and provide for the supervision of the FDFA.

To the extent possible, it shall include non-governmental organisations in the restitution process.

Die eingezogenen Vermögenswerte werden über die Finanzierung von Programmen von öffentlichem Interesse rückerstattet.

Zur Regelung der Rückerstattung kann der Bundesrat Abkommen abschliessen.

Solche Abkommen können insbesondere regeln: a. die Art der Programme von öffentlichem Interesse, die mit den rückerstatteten Vermögenswerten unterstützt werden sollen; b. die Verwendung der rückerstatteten Vermögenswerte; c. die an der Rückerstattung beteiligten Partner; d. die Kontrolle und Überwachung der Verwendung der rückerstatteten Vermögenswerte.

Kommt keine Einigung mit dem Herkunftsstaat zustande, so legt der Bundesrat die Rückerstattungsmodalitäten selber fest. Er kann insbesondere die eingezogenen Vermögenswerte über internationale oder nationale Institutionen rückerstatten und eine Überwachung durch das EDA vorsehen.

Er bezieht die Nichtregierungsorganisationen so weit wie möglich in den Rückerstattungsprozess ein.

La restitution des valeurs patrimoniales confisquées s’effectue par le financement de programmes d’intérêt public.

Le Conseil fédéral peut conclure des accords afin de régler les modalités de la restitution.

De tels accords peuvent porter notamment sur les éléments suivants: a. le type de programmes d’intérêt public auxquels sont destinées les valeurs patrimoniales restituées; b. l’utilisation des valeurs patrimoniales restituées; c. les partenaires impliqués dans la restitution; d. le contrôle et le suivi de l’utilisation des valeurs patrimoniales restituées.

A défaut d’accord avec l’Etat d’origine, le Conseil fédéral fixe les modalités de la restitution. Il peut notamment restituer les valeurs patrimoniales confisquées par l’entremise d’organismes internationaux ou nationaux et prévoir une supervision par le DFAE.

Il associe autant que possible les organisations non gouvernementales au processus de restitution.

Il Consiglio federale può concludere accordi per disciplinare le modalità della restituzione.

Tali accordi possono disciplinare segnatamente: a. il genere di programmi d’interesse pubblico a cui sono destinati i valori patrimoniali restituiti; b. l’utilizzo dei valori patrimoniali restituiti; c. i partner coinvolti nella restituzione; d. il controllo e il monitoraggio dell’utilizzo dei valori patrimoniali restituiti.

In assenza di un accordo con lo Stato di provenienza, il Consiglio federale stabilisce le modalità della restituzione. Può segnatamente restituire per il tramite di organismi internazionali o nazionali i valori patrimoniali confiscati e prevedere la supervisione da parte del DFAE.

Nei limiti del possibile, il Consiglio federale associa le organizzazioni non governative al processo di restituzione.
