In the event of an aviation accident resulting in the death of passengers or bodily injuries, the carrier shall make advance payments to the natural persons entitled to compensation as coverage for immediate economic needs. These advances must be paid within fifteen days from the identification of the natural persons entitled to compensation.

In the case of death, the advance payment shall not be less than the sum of 16,000 Special Drawing Rights.

The advance payments do not constitute an admission of liability. They may be deducted from the amounts subsequently paid by the carrier as compensation.

This article also applies within the scope of the Montreal Convention.

Hat ein Luftfahrzeugunfall den Tod oder die Körperverletzung von Reisenden zur Folge, so leistet der Luftfrachtführer Vorauszahlungen an schadenersatzberechtigte natürliche Personen zur Befriedigung ihrer unmittelbaren wirtschaftlichen Bedürfnisse. Diese Vorauszahlungen sind binnen 15 Tagen ab der Identifikation der schadenersatzberechtigten natürlichen Personen zu bezahlen.

Im Todesfall darf die Vorauszahlung nicht unter dem Betrag von 16 000 Sonderziehungsrechten liegen.

Die Vorauszahlungen stellen keine Haftungsanerkennung dar. Sie können mit späteren Schadenersatzleistungen des Luftfrachtführers verrechnet werden.

Dieser Artikel gilt ebenfalls im Geltungsbereich des Übereinkommens von Montreal.

En cas d’accident d’aviation entraînant la mort de passagers ou des blessures corporelles, le transporteur verse des avances aux personnes physiques ayant droit à une indemnisation à titre de couverture des besoins économiques immédiats. In caso di incidente aereo che provoca la morte o il ferimento del passeggero, il vettore provvede agli anticipi di pagamento a favore della persona o delle persone fisiche aventi diritto al risarcimento per far fronte alle loro immediate necessità economiche. Gli anticipi devono essere versati entro 15 giorni dall’identificazione delle persone fisiche che hanno diritto a un’indennità.

In caso di decesso l’anticipo non può essere inferiore alla somma di 16 000 diritti speciali di prelievo.

Gli anticipi non equivalgono a un riconoscimento della responsabilità. Essi possono essere dedotti dagli importi versati successivamente a titolo d’indennizzo.
