The Confederation and cantons may charge fees for the access to and use of official geodata.

They shall harmonise the principles of the fee structure for the official geodata and geodata services of national interest.

The Federal Council regulates the fees for the access to and use of basic geodata and the geodata services of the Confederation. The fees are made up as follows: a. for private use: marginal costs and a suitable contribution to infrastructure costs at the most; b. for commercial use: marginal costs and a suitable contribution to infrastructure, investment and revision costs appropriate to the use of the geodata.

Bund und Kantone können für den Zugang zu Geobasisdaten und deren Nutzung Gebühren erheben.

Sie harmonisieren die Grundsätze der Tarifierung für Geobasisdaten des Bundesrechts und für die Geodienste von nationalem Interesse.

Der Bundesrat regelt die Gebühren für den Zugang zu den Geobasisdaten des Bundes und für deren Nutzung sowie für die Nutzung der Geodienste des Bundes. Die Gebühren setzen sich zusammen aus: a. bei Nutzung zum Eigengebrauch: höchstens den Grenzkosten und einem angemessenen Beitrag an die Infrastruktur; b. bei gewerblicher Nutzung: den Grenzkosten und einem der Nutzung angemessenen Beitrag an die Infrastruktur sowie an die Investitions- und Nachführungskosten.

La Confédération et les cantons peuvent percevoir des émoluments pour l’accès aux géodonnées de base et pour leur utilisation.

Ils harmonisent les principes de tarification s’appliquant aux géodonnées de base relevant du droit fédéral et aux géoservices d’intérêt national.

Le Conseil fédéral réglemente les émoluments s’appliquant à l’accès aux géodonnées de base de la Confédération et à leur utilisation ainsi qu’à l’utilisation des géoservices de la Confédération. {note: Rectifié par la CdR de l’Ass. féd. (art. 58, al. 1, LParl; RS 171.10).} Les émoluments comprennent: a. en cas d’utilisation à des fins privées: au plus les coûts marginaux et une contribution appropriée aux coûts d’infrastructure; b. en cas d’utilisation à des fins commerciales: les coûts marginaux et une contribution appropriée, en rapport avec l’utilisation prévue, aux coûts d’infrastructure ainsi qu’aux coûts d’investissement et de mise à jour.

La Confederazione e i Cantoni possono riscuotere emolumenti per l’accesso ai geodati di base e per la loro utilizzazione.

Armonizzano i principi tariffari per i geodati di base di diritto federale e per i geoservizi di interesse nazionale.

Il Consiglio federale disciplina gli emolumenti per l’accesso ai geodati di base della Confederazione e per la loro utilizzazione, nonché per l’utilizzazione dei geoservizi della Confederazione. Gli emolumenti comprendono: a. in caso di utilizzazione per uso proprio, al massimo i costi marginali e un adeguato contributo all’infrastruttura; b. in caso di utilizzazione commerciale, i costi marginali e un contributo all’infrastruttura e ai costi di investimento e di aggiornamento, adeguato all’utilizzazione.
