The land registry office issues the title to the creditor or their representative only with the written consent of the debtor and the owner of the encumbered property (Art. 861, para. 3, CC).

This consent may be provided in the application for the registration of the lien in the land register.

Der Pfandtitel wird dem Gläubiger, der Gläubigerin oder einer vertretungsberechtigten Person nur ausgehändigt, wenn der Schuldner oder die Schuldnerin sowie der Eigentümer oder die Eigentümerin des belasteten Grundstücks schriftlich ihre Zustimmung erklärt haben (Art. 861 Abs. 3 ZGB).

Diese Einwilligung kann in die Anmeldung zur Eintragung des Pfandrechts in das Grundbuch aufgenommen werden.

L’office du registre foncier ne délivre le titre au créancier ou à son représentant qu’avec le consentement écrit du débiteur et du propriétaire de l’immeuble grevé (art. 861, al. 3, CC).

Ce consentement peut être donné dans la réquisition d’inscription du droit de gage au registre foncier.

Il titolo di pegno non può essere consegnato al creditore o a un rappresentante senza il consenso scritto del debitore e del proprietario del fondo serviente (art. 861 cpv. 3 CC).

Il consenso può essere inserito nella notificazione per l’iscrizione del diritto di pegno nel registro fondiario.
