Private controllers with registered office or domicile abroad shall appoint a representative in Switzerland if they process the personal data of persons in Switzerland and the data processing meets the following requirements: a. The processing is connected with the offer of goods or services or the monitoring of the behaviour of persons in Switzerland. b. The processing is on a large scale. c. The processing is carried out regularly. d. The processing poses a high risk to the personality of the data subjects.

The representative shall serve as the contact point for the data subjects and the FDPIC.

The controller shall publish the name and the address of the representative.

Private Verantwortliche mit Sitz oder Wohnsitz im Ausland bezeichnen eine Vertretung in der Schweiz, wenn sie Personendaten von Personen in der Schweiz bearbeiten und die Datenbearbeitung die folgenden Voraussetzungen erfüllt: a. Die Bearbeitung steht im Zusammenhang mit dem Angebot von Waren und Dienstleistungen oder der Beobachtung des Verhaltens von Personen in der Schweiz. b. Es handelt sich um eine umfangreiche Bearbeitung. c. Es handelt sich um eine regelmässige Bearbeitung. d. Die Bearbeitung bringt ein hohes Risiko für die Persönlichkeit der betroffenen Personen mit sich.

Die Vertretung dient als Anlaufstelle für die betroffenen Personen und den EDÖB.

Der Verantwortliche veröffentlicht den Namen und die Adresse der Vertretung.

Le responsable du traitement privé qui a son siège ou son domicile à l’étranger désigne un représentant en Suisse lorsqu’il traite des données personnelles concernant des personnes en Suisse et que ce traitement remplit les conditions suivantes: a. le traitement est en rapport avec l’offre de biens ou de services ou le suivi du comportement de personnes en Suisse; b. il s’agit d’un traitement à grande échelle; c. il s’agit d’un traitement régulier; d. le traitement présente un risque élevé pour la personnalité des personnes concernées.

Le représentant est le point de contact pour les personnes concernées et le PFPDT.

Le responsable du traitement publie le nom et l’adresse de son représentant.

I titolari privati del trattamento con sede o domicilio all’estero designano un rappresentante in Svizzera se trattano dati personali concernenti persone in Svizzera e il trattamento: a. è legato a un’offerta di merci o prestazioni o finalizzato a porre sotto osservazione il comportamento di dette persone; b. è un trattamento su grande scala; c. è un trattamento periodico; e d. comporta un rischio elevato per la personalità delle persone interessate.

Il rappresentante funge da interlocutore per le persone interessate e l’IFPDT.

Il titolare del trattamento pubblica il nome e l’indirizzo del rappresentante.
