Anyone who, for purposes of research and development, handles unauthorised biocidal products or non-approved active substances for use in biocidal products in such a way that they may be released into the environment must declare this to the Notification Authority 45 days before they are so handled for the first time.

The declaration must include the records specified in Article 13 e paragraph 1.

If the proposed release tests could have unacceptable effects on humans, particularly on vulnerable groups, on animals or on the environment, the Notification Authority may: a. make the conduct of the test subject to conditions, concerning in particular: 1. the duration of experiments or tests, 2. the maximum quantities to be used, 3. restriction of the area of use; b. prohibit the test.

If the biocidal products or active substances under investigation are genetically modified or pathogenic microorganisms, or if they contain such microorganisms, the procedure shall be based on the RO .

Wer mit Biozidprodukten, die nicht zugelassen sind, oder mit nicht genehmigten Wirkstoffen zur Verwendung in Biozidprodukten zu Forschungs- und Entwicklungszwecken so umgeht, dass diese in die Umwelt freigesetzt werden können, hat dies der Anmeldestelle 45 Tage vor dem ersten Umgang mitzuteilen.

Die Mitteilung muss die Aufzeichnungen nach Artikel 13 e Absatz 1 enthalten.

Können die vorgesehenen Freisetzungsversuche unannehmbare Auswirkungen auf Menschen, insbesondere auf gefährdete Gruppen, auf Tiere oder auf die Umwelt haben, so kann die Anmeldestelle: a. die Durchführung des Versuchs mit Auflagen verknüpfen, insbesondere betreffend: 1. die Dauer von Experimenten oder Tests, 2. die zu verwendenden Höchstmengen, 3. die Begrenzung des Einsatzgebietes; b. den Versuch untersagen.

Sind die zu untersuchenden Biozidprodukte oder Wirkstoffe gentechnisch veränderte oder pathogene Mikroorganismen oder enthalten sie solche, so richtet sich das Verfahren nach der FrSV .

Toute personne qui utilise, à des fins de recherche et de développement, des produits biocides n’étant pas autorisés ou des substances actives non approuvées destinées à être incorporées dans des produits biocides, de telle manière qu’ils soient susceptibles d’être disséminés dans l’environnement, doit le déclarer à l’organe de réception des notifications 45 jours avant leur première utilisation:

La déclaration doit comporter les données visées à l’art. 13 e, al. 1.

Si les essais de dissémination sont susceptibles d’entraîner des effets inacceptables sur l’être humain, en particulier les groupes vulnérables, les animaux ou l’environnement, l’organe de réception des notifications peut: a. lier la réalisation de l’essai à des charges, notamment en ce qui concerne: 1. la durée des essais ou des tests, 2. les quantités maximales admises, 3. la limitation des zones à traiter; b. interdire l’essai.

Si les produits biocides ou substances actives destinés à faire l’objet d’essais consistent en des microorganismes pathogènes ou génétiquement modifiés, ou qu’ils contiennent de tels microorganismes, la procédure est régie par l’ODE {note: RS 814.911} .

Chi utilizza biocidi non omologati o contenenti principi attivi non approvati per l’uso in biocidi a scopo di ricerca o sviluppo con la possibilità che tali biocidi possano essere emessi nell’ambiente deve comunicarlo all’organo di notifica 45 giorni prima del primo utilizzo.

La comunicazione deve contenere le annotazioni di cui all’articolo 13 e capoverso 1.

Se le emissioni sperimentali previste possono avere effetti inaccettabili sull’uomo, in particolare sui gruppi vulnerabili, sugli animali o sull’ambiente, l’organo di notifica può: a. vincolare lo svolgimento della sperimentazione a oneri concernenti segnatamente: 1. la durata degli esperimenti o test, 2. le quantità massime da utilizzare, 3. la limitazione del campo d’impiego; b. vietare la sperimentazione.

Se i biocidi o i principi attivi da esaminare sono costituiti da o contengono microrganismi patogeni o geneticamente modificati, la procedura è retta dall’OEDA {note: RS 814.911} .
