The mandate prescribing the establishment of a DNA profile must include the surname, first name, date of birth, address, and place of origin or nationality of the persons concerned.

Before the sample is taken, the identity of the persons concerned must be verified using a valid official identity document with a photo. This document must be copied. The laboratory may waive the requirement for an identity document for children who are no older than 4 years.

The examination of identity must be recorded, and the relevant documentation must be attached to the expert report provided for in Art. 16.

Im Auftrag zur Erstellung von DNA-Profilen ist von den zu untersuchenden Personen die Angabe von Familienname, Vorname, Geburtsdatum, Adresse sowie Heimatort oder Staatsangehörigkeit erforderlich.

Vor der Probeentnahme muss die Identität der zu untersuchenden Personen mit einem gültigen amtlichen Ausweis mit Foto festgestellt werden. Der Ausweis muss kopiert werden. Bei Kindern bis vier Jahren kann auf die Vorlage eines amtlichen Ausweises verzichtet werden.

Die zu untersuchende Person ist vor Probeentnahme zu fotografieren. Das Foto ist von ihr oder von ihrer gesetzlichen Vertreterin oder von ihrem gesetzlichen Vertreter zu unterschreiben.

Die Identitätsprüfung muss dokumentiert werden. Die Dokumentation muss dem Gutachten nach Artikel 16 beigelegt werden.

Die Person, welche die Identitätsprüfung durchführt und die Probe entnimmt, muss die Richtigkeit der Angaben mit ihrer Unterschrift bestätigen.

Wird die Probeentnahme einem anderen geeigneten Laboratorium, einer Ärztin oder einem Arzt oder einer anderen geeigneten Person übertragen, so ist das auftraggebende Laboratorium für die Instruktion des zuständigen Personals über die Identitätsprüfung sowie die Entnahme und Aufbewahrung der Probe verantwortlich.

La personne qui procède à l’examen d’identité et au prélèvement de l’échantillon doit confirmer par sa signature l’exactitude des données.

Si le prélèvement de l’échantillon est confié à un autre laboratoire approprié, à un médecin ou à une autre personne appropriée, le laboratoire mandant est responsable de l’instruction du personnel compétent relative à l’examen de l’identité ainsi qu’au prélèvement et à la conservation de l’échantillon.

Sul mandato di allestimento del profilo del DNA occorre indicare il cognome, il nome, la data di nascita, l’indirizzo, il luogo d’origine o la cittadinanza delle persone interessate.

Prima del prelievo del campione, occorre accertare l’identità delle persone interessate per mezzo di un documento di legittimazione ufficiale valido corredato di una fotografia. Tale documento deve essere fotocopiato. I laboratori possono rinunciare alla produzione di un documento di legittimazione ufficiale di bambini di età inferiore ai quattro anni.

Prima del prelievo del campione, la persona interessata è fotografata. La fotografia è firmata da quest’ultima o dal suo rappresentante legale.

L’esame dell’identità deve essere documentato. La documentazione deve essere allegata alla perizia giusta l’articolo 16.

La persona che effettua l’esame dell’identità e il prelievo del campione conferma l’esattezza dei dati con la sua firma.

Se il prelievo del campione è affidato a un altro laboratorio idoneo, a un medico o a un’altra persona idonea, il laboratorio committente è responsabile dell’istruzione del personale competente sull’esame dell’identità, sul prelievo e sulla conservazione del campione.
