When evidence cannot be presented during the hearings, for example, due to the illness of witnesses or experts, or when a site visit before the hearings is necessary, the president of the military tribunal shall personally administer the evidence or assign one or more judges to do so.

If possible, the parties will be given the opportunity to attend the administration of the evidence. If they do not attend, the record shall be communicated to them before the hearings.

Kann ein Beweis in der Hauptverhandlung, beispielsweise wegen Krankheit eines Zeugen oder Sachverständigen, voraussichtlich nicht erhoben werden oder ist es zweckmässig, vor der Hauptverhandlung einen richterlichen Augenschein vorzunehmen, so führt der Präsident des Militärgerichts diese Beweisaufnahme selbst durch oder lässt sie durch einen oder mehrere Richter vornehmen.

Den Parteien ist wenn möglich Gelegenheit zu geben, der Beweisaufnahme beizuwohnen. Sind sie nicht erschienen, so ist ihnen das Protokoll vor der Hauptverhandlung vorzulegen.

Lorsqu’une preuve ne pourra être administrée aux débats, par exemple à la suite de la maladie de témoins ou d’experts, ou qu’une visite des lieux avant les débats est indiquée, le président du tribunal militaire procède lui-même à l’administration de la preuve ou en charge un ou plusieurs juges.

Si cela est possible, la faculté sera donnée aux parties d’assister à l’administration de la preuve. Si elles n’y assistent pas, le procès-verbal leur en sera communiqué avant les débats.

Se si prevede che una prova non potrà essere assunta nel dibattimento, per esempio a cagione della malattia di un testimone o di un perito, o se è indicato di far eseguire prima del dibattimento un’ispezione da parte dell’autorità giudiziaria, il presidente del tribunale militare procede lui stesso a questa assunzione di prove o ne incarica uno o più giudici.

Se possibile, alle parti è data facoltà di assistere all’assunzione delle prove. Se non vi assistono, il processo verbale deve essere comunicato loro prima del dibattimento.
