Articles 5 and 7 to 11 apply by analogy to the emblems of the Red Crescent, the Red Lion and Sun on a white background, the emblem of the Third Additional Protocol to the Geneva Conventions, and to the words “Red Crescent,” “Red Lion and Sun,” and “Third Protocol emblem” or “Red Crystal.” The rights are reserved for those who have been using these emblems or words since a date prior to April 1, 1950, or December 8, 2005, in the case of the emblem of the Third Protocol to the Geneva Conventions, provided that they acquired these rights before these dates and that such use cannot appear, in times of armed conflict, as intended to confer the protection of the Geneva Conventions and, where applicable, the Additional Protocols of 1977.

Die Artikel 5 und 7–11 sind sinngemäss anwendbar auf die Zeichen des roten Halbmondes, des roten Löwen mit roter Sonne auf weissem Grund und das Schutzzeichen des dritten Zusatzprotokolls vom 8. Dezember 2005 {note: SR 0.518.523} zu den Genfer Abkommen sowie auf die Worte «Roter Halbmond», «Roter Löwe mit Roter Sonne» und «Schutzzeichen des dritten Protokolls» oder «Roter Kristall».

Vorbehalten bleiben die Rechte von Personen, die diese Zeichen oder Worte seit einem früheren Zeitpunkt als dem 1. April 1950 oder, im Falle des Schutzzeichens des dritten Zusatzprotokolls, dem 8. Dezember 2005 verwenden, sofern sie diese Rechte vor den genannten Zeitpunkten erworben haben und solange diese Verwendung während eines bewaffneten Konflikts nicht den Anschein erweckt, dass damit der Schutz der Genfer Abkommen und gegebenenfalls ihrer Zusatzprotokolle {note: SR 0.518.521; 0.518.522} beansprucht werden soll.

Les art. 5 et 7 à 11 s’appliquent par analogie aux emblèmes du croissant rouge, du lion et du soleil rouges sur fond blanc, à l’emblème du troisième Protocole additionnel aux Conventions de Genève {note: RS 0.518.523} et aux mots «croissant rouge», «lion et soleil rouges» et «emblème du troisième Protocole» ou «cristal rouge».

Sont réservés les droits de ceux qui font usage de ces emblèmes ou mots depuis une date antérieure au 1 er avril 1950 ou au 8 décembre 2005 dans le cas de l’em-blème du troisième Protocole aux Conventions de Genève, pour autant qu’ils aient acquis ces droits avant ces dates et pour autant que cet usage ne puisse pas apparaître, en temps de conflit armé, comme visant à conférer la protection des Conventions de Genève et, le cas échéant, des Protocoles additionnels de 1977 {note: RS 0.518.521; 0.518.522} .

Gli articoli 5 e 7–11 si applicano per analogia agli emblemi della Mezzaluna Rossa, del Leone e del Sole Rossi su fondo bianco e all’emblema del terzo Protocollo aggiuntivo dell’8 dicembre 2005 {note: RS 0.518.523} alle Convenzioni di Ginevra, nonché alle espressioni «Mezzaluna Rossa», «Leone e Sole Rossi» e «emblema del terzo Protocollo aggiuntivo alle Convenzioni di Ginevra» o «Cristallo Rosso».

Sono salvi i diritti di coloro che fanno uso di detti segni o espressioni da una data anteriore al 1° aprile 1950 o, nel caso dell’emblema del terzo Protocollo aggiuntivo alle Convenzioni di Ginevra, da una data anteriore all’8 dicembre 2005, per quanto abbiano acquisito tali diritti prima delle date menzionate e fintanto che questo uso durante un conflitto armato non dia l’impressione di essere inteso a conferire la protezione delle Convenzioni di Ginevra e, se del caso, dei loro Protocolli aggiuntivi del 1977 {note: RS 0.518.521; 0.518.522} .
