The: [tab] "Swiss Hotel Credit Society" (SCH), [tab] "Schweizerische Gesellschaft fĂĽr Hotelkredit" (SGH), [tab] "SocietĂ svizzera di credito alberghiero" (SCA), is a cooperative society under public law within the meaning of Art. 829 of the Swiss Code of Obligations (CO). Its registered office is in Zurich and it is registered in the commercial register.
The provisions of the CO relating to private law cooperatives (Art. 828 to 920) are applicable insofar as the Federal Law of June 20, 2003, on the Promotion of the Hospitality Sector (the law), the ordinance, and these statutes do not provide otherwise.
Unter dem Namen: [tab] «Schweizerische Gesellschaft für Hotelkredit SGH» [tab] «Société suisse de crédit hôtelier SCH» [tab] «Società svizzera di credito alberghiero SCA» besteht eine Genossenschaft des öffentlichen Rechts im Sinne von Artikel 829 des Obligationenrechts {note: SR 220} (OR). Die Gesellschaft hat ihren Sitz in Zürich und ist im Handelsregister eingetragen.
Soweit das Bundesgesetz vom 20. Juni 2003 {note: SR 935.12} über die Förderung der Beherbergungswirtschaft (Gesetz), die Verordnung und die vorliegenden Statuten nichts anderes vorschreiben, finden die Bestimmungen des OR über die Genossenschaft des privaten Rechts (Art. 828–920) Anwendung.
La: [tab] «Société suisse de crédit hôtelier» (SCH), [tab] «Schweizerische Gesellschaft für Hotelkredit» (SGH), [tab] «Società svizzera di credito alberghiero» (SCA), est une société coopérative de droit public au sens de l’art. 829 du code des obligations (CO) {note: RS 220} . Elle a son siège à Zurich et est inscrite au registre du commerce.
Les dispositions du CO relatives à la société coopérative de droit privé (art. 828 à 920) sont applicables, pour autant que la loi fédérale du 20 juin 2003 sur l’encouragement du secteur de l’hébergement (loi) {note: RS 935.12} , l’ordonnance et les présents statuts n’en disposent pas autrement.
Sotto il nome di: [tab] «Società svizzera di credito alberghiero SCA» [tab] «Schweizerische Gesellschaft für Hotelkredit SGH» [tab] «Société suisse de crédit hôtelier SCH» è istituita una società cooperativa del diritto pubblico ai sensi dell’articolo 829 del Codice delle obbligazioni {note: RS 220} (CO). La società ha sede a Zurigo ed è iscritta nel registro di commercio.
Per quanto la legge federale del 20 giugno 2003 {note: RS 935.12} sulla promozione del settore alberghiero (legge), l’ordinanza e il presente statuto non dispongano altrimenti, sono applicabili le disposizioni del CO che disciplinano la società cooperativa di diritto privato (art. 828–920).
