Art. 8 Gesetz über die Verwaltungsrechtspflege (VRPG) · Verwaltungs-, Zivil- oder Strafrechtspflege
Erachtet der Regierungsrat oder das Verwaltungsgericht nach einem Meinungsaustausch mit dem Obergericht die bernischen Zivil- oder Strafgerichte für zuständig und liegt kein Fall von Artikel 7 vor, so sind die Akten zusammen mit dem Entscheid über die Zuständigkeit dem Obergericht zuzustellen. Stimmt dieses nicht zu, so entscheidet auf Ansuchen der zuerst angegangenen Behörde der Grosse Rat über die Zuständigkeit (Art. 79 Abs. 1 Bst. d der Kantonsverfassung).
Ist eine untere Verwaltungsjustizbehörde der Meinung, die bernischen Zivil- oder Strafgerichte seien zuständig, und liegt kein Fall von Artikel 7 vor, so leitet sie die Akten zum Entscheid über die Zuständigkeit an die Rechtsmittelbehörde weiter.
