Art. 42 Gesetz über die Verwaltungsrechtspflege (VRPG) · Wahrung

1. Zur Wahrung einer Frist muss die betreffende Handlung vor Ablauf der Frist vorgenommen werden.

2. Eingaben müssen vor Ablauf der Frist der Behörde, der schweizerischen Post oder einer schweizerischen diplomatischen oder konsularischen Vertretung übergeben werden.

3. Fristen sind auch gewahrt, wenn die Eingabe rechtzeitig bei einer unzuständigen bernischen oder eidgenössischen Verwaltungs- oder Gerichtsbehörde eingereicht worden ist.

4. Die Frist für die Zahlung eines Vorschusses oder für eine Sicherstellung ist gewahrt, wenn der Betrag rechtzeitig zugunsten der zuständigen Behörde der Schweizerischen Post übergeben oder einem Post- oder Bankkonto in der Schweiz belastet worden ist.
