Art. 27 Gesetz über die Verwaltungsrechtspflege (VRPG) · Voraussetzungen
1. Die instruierende Behörde kann auf Antrag oder von Amtes wegen in folgenden Fällen vor dem Erlass einer Verfügung oder eines Entscheides vorsorgliche Massnahmen anordnen
a zur Beseitigung gesetzwidriger oder gefährlicher Anlagen und Zustände, zur Ausführung dringender Arbeiten und zum Schutz erheblicher öffentlicher oder privater Interessen;
b gegen die wesentliche Veränderung oder Veräusserung der Streitsache;
c zum Schutz von andern als auf Geld- oder Sicherheitsleistung gerichteten, fälligen Rechtsansprüchen, wenn bei nicht sofortiger Erfüllung
1. ihre Vereitelung oder eine wesentliche Erschwerung ihrer Befriedigung zu befürchten ist oder
2. ein erheblicher oder nicht leicht zu ersetzender Schaden oder Nachteil droht.
2. Vorsorgliche Massnahmen können von Amtes wegen oder auf Antrag abgeändert oder aufgehoben werden, wenn die Voraussetzungen zu ihrem Erlass ganz oder teilweise dahingefallen sind.
