Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible because the sole ground contesting the sentencing and recidivism determination was manifestly unfounded. The appellant argued against the confirmation of recidivism, but the lower court's decision was supported by sufficient and non-illogical reasoning that adequately addressed the defense's submissions. Consequently, the court ruled that the substantive judgment on this point was not subject to review at this stage.

Art. 616 cod. proc. pen.; An appeal is inadmissible if the only ground raised is manifestly unfounded, provided the lower court's decision is supported by sufficient and non-illogical reasoning that adequately examines the defense's arguments.

616 cod. proc. pen.
