Letto il ricorso di Cosimo Castellano; ritenuto che il motivo con il quale si deduce la prescrizione del reato risulta fondato, se si considera che: il reato è stato commesso nel marzo 2013; si tratta di una truffa tentata ed è stata contestata la recidiva specifica infraquinquennale, così che la pena detentiva massima è di anni tre di reclusione; il termine ordinario di prescrizione è di sei anni e quello prorogato, in ragione della contestata recidiva, è di nove anni; il reato, pertanto, in assenza di periodi di sospensione del termine di prescrizione, si è prescritto nel marzo 2022, dunque anteriormente all'emissione della sentenza di appello, che data 7 ottobre 2024; rilevato, pertanto, che la sentenza impugnata deve essere annullata senza rinvio
